proposed vacation, and being of the opinion that the prayer of said
petition should be granted upon the terms hereinafter stated, did duly
report its conclusions to said Board of Aldermen, recommending the adop-
tion of an appropriate resolution declaring such vacation; now therefore,
it is hereby
RESOLVED, By the Common Council of the City of St . Paul, that
that portion of Olive street lying between the southerly line of East
Fifth street and the northerly line of East Fourth street, in said City
of St . Paul, as shown upon the plat annexed to said petition, be and the
same is hereby vacated and discontinued as a public street, subject, how-

IN THE IV:ATTER OF THE PETITION OP TEE ST . PAUL GAS LIGHT
COMPANY FOR THE VACATION OF THAT PART OF OLIVE STREET IN THE
CITY OF ST. PAUL, LYING BETWEEN THE SOUTHERLY LINE OF EAST
FIFTH STREET AND THE NORTHTRLY LINE OF EAST FOURTH STREET IN
SAID CITY.
To the Honorable,
The Common Council of the City of St. Paul:
The petition of the St . Paul Gas Light Company
respectfully shows :
I.
That the St . Paul Gas Light Company is a corporation
organized under the laws of the State of Minnesota, and owns
in fee simple all of blocks Forty-six (46) and Forty-seven (47)
in Kittson's Addition to the City of St, Paul, according to
the plat thereof on file and of record in the office of the
Register of Deeds of Ramsey County, Minnesota, and is the
owner of all the property fronting on that part of Olive
Street in the City of St. Paul, between the southerly line of
East Fifth Street and the northerly line of East Fourth Street
in said city. That the principal place of business of your
petitioner is the City of St . Paul, Minnesota.
II.
That hereto annexed and made a part hereof is a true
and correct plat of that part of Olive Street proposed to be
vacated; that the said part of Olive Street is not suitable for
a public highway, and has not been graded, improved or other-
.
wise prepared for public use, and that by reason of the fact
that your petitioner owns the land on both sides thereof, and
that railroad tracks and yards are situated at the southerly
end thereof, there is no public traffic on said part of Olive
Street, and the said part of Olive Street is no longer useful
as a public highway and is of no value or use to the public
as a highway, but the use thereof would be of advantage to
your petitioner in connection with its gas works and shops.
III.
In consideration of said vacation your petitioner
will pay to the City the ordinary expenses of conducting the
vacation proceedings, and in addition thereto, the sum of
Fifteen Thousand ( 15,000) Dollars, and will also render
obedience to the ordinance of the City of St. Paul fixing the
maximum net price of gas at ninety-five ( 95) cents per thousand
cubic feet after March 1, 1913, and at ninety ( 90) cents per
thousand cubic feet after January 1st, 1914.
WHERTWORE, Your petitioner prays that your Honorable
Body may vacate and discontinue said part of Olive Street as
a public highway.
