The proposed dedication of said street has not been accept- ed by the public authorities and said proposed street has never been opened, graded or otherwise used as a street. Aside from that por- tion thereof included in said respective cemeteries, it is used as a meadow. There is no public necessity for a street at that point and the public interest does not require that it be opened or used as such. If said street is vacated, it is the intention of your pet- itioners to use and occupy the same as part of their respective cemeteries Your petitioners represent that they are the owners of all the property abutting upon both sides of said Walsh Avenue throughout ee its entire length except lot eleven in block five of Catlin' s Addition the owner of which does not object to the vacation of said street and there are no unpaid taxes assessed against any of the property refered to in this petition. WHEREFORE your petitioners pray that the common council by proper resolution declare said Walsh Avenue in said Catlin's Addition to St.Paul, vacated to the end that the ownership of the land embraced within the lines of said street maybe freed from any existing casement or other right therein and that the same may be used as an enlargement of each of said cemeteries..
