McGINN,A SS,CLERK .dune 28th,1912 Hon.O.H.O'Neill Corporation Attorney, City Dear Sir,— The Committee on Streets of the Board of Aldermen at their meeting held June 27th,1912 rnadefavorable report on the petition of W.L1.Robinson,et a1 for the vacation of a part of Bayless and Manvel streots,being a miscellaneous piece at the S.W.cDrner of said streets,fixing the compensation at $5.00 and cost of proceedings.,and same is referred to you for proper form of resolution. Herewith find all papers in connection therewith. Yours truly • /City cleric. • • 4L fi \, AND WHEREAS, said Committee did then and there duly adjourn the consideration thereof until June 27 , 1912, at four o 'clock P . M. at the same place, and said Committee on Streets did duly meet at said last mentioned time and place for the hearing and consideration thereof and did then and there duly investigate and consider the matter of said pro- posed vacation and did then and there hear all the testimony and evidence adduced on the part of the petitioners and all other persons interested in the matter of said proposed vaca- tion and did take proof of the matters averred in said peti- tion, and being of the opinion that the prayer of said peti- tion should be granted upon the terms hereinafter stated, did duly report its conclusions to said Board of Aldermen recom- mending the adoption of an appropriate resolution declaring such vacation; NOW THEREFORE, It is hereby resolved by the Common Council of St . Paul that all that portion of Bayless Avenue and L7anvel Street being at the southwest corner of said Bay- less Avenue and Manvel Street and described as follows : Start- ing at a point about twenty-eight (28) feet north of the south line of Lot twenty-five (25) , Block sixty-five (65) St . Anthony Park; thence northerly along the line of Bayless Avenu produced, about ninety-four (94) feet to a point where it will intersect with the south line of Manvel Street, produced; thence westerly along the line of Manvel Street, produced, about ninety-four (94) feet where it will meet the end of the present radius cor- ner; thence in a southeasterly direction around the present line of the street to the point of beginning, this same line having a • radius of about ninety-four (94) feet as shown in red upon the plat annexed to said petition; be and the same is hereby vacated and discontinued as part of a public street or streets, subject, -2- • • • 1/ • • • • ttF� AA- 0% 1 however, to the following terms and conditions, that is to say: Such vacation is upon the express condition that said petitioner W. ?.. Robinson shall re-lay the sidewalks to con- form with the newly constructed lines, all at his own expense and to the satisfaction of the Commissioner of Public Works, and shall pay into the treasury of said city the sum of Five Dollars 0'5.00) in addition to the expenses of this proceeding, which is hereby fixed as the compensation to be paid to said city in consideration of said vacation . That, in order tc build on said lot number twenty-six (26 ) , a structure would of necessity be forced at least twenty (20 ) feet back of the building line of lot number twenty-five (25 ), adjacent , or, as the only alternative , must be placed on the rear of the lot, alongside the alley, and facing Manvel Street. That, while Lot twenty-six (26 ) has but fifty-five and seven-tenths (55.7 ) feet parallel with sewer, between two and three times that distance has been assessed and paid. That the ,portion of street in question - marked red in the plat - is of no value to the public, is largely seeded to weeds, and renders the Intersection of Bayless Avenue and Manvel Street unsightly and unsymmetrical. That the owner of said lot number twenty-stx (26 ), your petitioner, desiring to improve said lot and corner by erecting thereon a modern residence s zitable tc the locality, finds it impossible to do so under existing conditions. In conclusion, the undersigned desires to express his willingness- to bear all the expense necessary to consummate the vacation petitioned for and agrees to relay the sidewalks to con- form with the newly constructed lines.
