Gentlemen, - We, the undersigned petitioners, as owners of all of the property on both sides of the Stillwatee Road east of Hazel Ave. in the City of St. Paul do respectfully ask that you grant the prayer of these petitioners to have that old and untraveled portion of the Stillwater Road east of Hazel Ave. to a connection with the present Stillwater Road now traveled and as shown in green on the accompanying plan vacated. The facts and reasons for such vacation are as follows: Stillwater Road as graded and traveled by the City connects with Kerwin St. as graded and traveled, consequently that part of the street for which the vacation is asked is of no use to the public, and further in consideration of said vacation your petitioners will rive and dedicate to the public use all that part of the Stillwater Road which has been recently graded by the City and is now used by the public as a traveled street, described as follows: "A strip of land 66 feet wide in the N. E. a of the S. W. 1 of Section 26, T. 29 N. , R. 22 W. the center line of said strip described as follows: Beginning at the intersection of the center lines of Hazel Ave, and Kerwin St. ; thence N. 65° 23' E, a distance of 850. 54 feet to an intersection with the center line of, the old Stillwater Road. " WHEREFORE your petitioners pray that the vacation as heretofore described be granted. iief...s , l/ ` /* i A • WHEREAS, Said Committee on Streets of said Assembly did meet at said last named time and place above mentioned and appointed there- for, and did then and there hear all testimony and evidence adduced on the part of said petitioner and all other persons interested in the matter of said proposed vacation, and did take proof of the matters averred in said petition, and being of the opinion that the prayer of said petition should be granted to the extent and upon the terms here- inafter stated, did duly report its conclusions to said Assembly, re- commending the adoption of an appropriate resolution declaring said vacation; now therefore, it is hereby RESOLVED, By the Common Council of the City of St . Paul that all that part of the old Stillwater Road east of the west line of the northeast quarter of the southwest quarter of Section 26, Township 29 North, Range 22 West, and west of a point distant 850 .54 feet north 65 degrees 23 minutes east of the intersection of the center lines of Hazel avenue and Kerwin street and which is not included in a strip of land 66 feet wide, the center line of which begins at the intersection of the center lines of Hazel avenue and Kerwin street and runs thence north 65 degrees 23 minutes east a distance of 850 .54 feet, as shown upon said plat, be and the same is hereby vacated and discontinued as a public road, subject to the following conditions, that is to say: Such vacation is upon condition that said petitioner shall, before this resolution takes effect, pay into the treasury of said City the expenses of this proceeding, and in addition thereto said petitioner shall convey and dedicate to the City for use as a public road and street all the land shogin in red upon said plat, and described as follows : A strip of land 66 feet wide in the northeast quarter of the southwest quarter of Section 26, Township 29 north, Range 22 west , the center line of said strip described as follows : Beginning at the inter- - section of the center lines of Hazel avenue and Kerwin street, thence north 65 degrees 23 minutes east, a distance of 850 .54 feet to an inter- . section with the center line of the old Stillwater Road; which is fixed as the compensation for said vacation.
