did take proof of the matters averred in said petition, and being of the
opinion that the prayer of said petition should be granted upon the terms
hereinafter stated, did duly report its conclusions to said. Board of
Aldermen, recommending the adoption of an appropriate resolution declar-
ing said vacation; now therefore , it is hereby
Resolved, By the Common Council of the City of St . Pa 1, that
all that portion of the alley which runs between Lots 13 to 17 an
Lots 18 to 24 inclusive , in Block 1 of Capitol Addition, as shown upon
said plat , be and the same is hereby vacated and discontinued as a public
alley , subject , however, to the following conditions , that is to say:
Such vacation is based upon the condition that said petition-
ers shall , before this resolution takes effect , pay into the Trea ury of
said City the expenses of this proceeding , and shall convey to th City
of St . Paul , for alley purposes, the easterly sixteen (16) feet i. width,
of Lot thirteen (13) in said block, which is hereby fixed as the com-
pensation for such vacation . _

To the Common Council City of St .Paul.
Gentlemen:
7e the under signed and owners of lot 13 to 24
inclusive, of block one, Capitol Addition, to the City of
St .Paul.
Respectfully recyuest your honorable body to va-
cate that portion of the alley, which runs between lots
from 13 to 17 and 18 to 24 inclusive, in the above addition.
The same beginning on the ?last line of Finn Ave. , thence
running 303.82 feet easternly.
Your petitioner is the owner of all the property
abutting on this alley and is willing to deed to the City,
for an alley, a strip 16 feet wide all on the easternly side
of lot 13, in block one , in said Capitol Addition, which would
make an alley way through the block, which would be satisfact-
ory to the balance of the property owners.
