The Committee did not fix any compensation for the vacation, in addition to the expense of the proceeding; consequently I have left a blank in the resolution to be filled in in such an amount as the Common Council may determine . I j I i WHEREAS , There was heretofore presented to the Assembly, one of the branches of the Common Council of the City of St . Paul, the petition of Griggs, Cooper & Company, a corporation, and others, the owners of all the land and property abutting upon and adjoining the streets and alleys hereinafter described, praying for the vacation of Edmund street from Fairview avenue to Aldine street , also Charles street from Fairview avenue to Aldine street, Sherburne avenue from Fairview avenue to the easterly line of Lot 27 in Block 5 and the easterly line of Lot 4 in Block 8, of Dickerman Park, also Wheeler avenue from University avenue to Thomas street, also all of the alleys in Blocks 1, 2, 3, 4 , 6 , 7 and 8, and the alley in Block 5, from Wheeler avenue to the easterly line of Lots 4 and 27 in said Block 5 of Dickerman Park Addition to St . Paul, Minnesota, and more particularly shown and des- cribed upon the plat annexed to said petition, which said petition is duly verified as required by law and sets forth the facts and reasons for such vacation; and WHEREAS, Said Assembly deemed it expedient that the matter therein referred to should be proceeded with and ordered said petition and accompanying plat to be filed of record in the office of the City Clerk of said City, and ordered said City Clerk to give notice by publi- cation in the official paper of said City in the manner and for the time required by law, that said petition and the subject matter thereof would be heard and considered by the Committee on Streets of said Assembly at its regular meeting to be held in the Council Chamber in the Court House and City Hall Building , in said City, on the 2nd day of November, 1908 , at four o ' clock P . M. , which said notice was duly published and given; and WHEREAS, Said Committee on Streets of said Assembly did meet at the time and place above mentioned and appointed therefor, and did then and there duly adjourn the hearing and consideration of said matter J until the next regular meeting of said Committee appointed to be held at the same place on the 16th day of November, 1908, at four o'clock res 4 P . M. , and said Committee did at said last named time and place duly meet for the investigation and consideration thereof, and did then and there hear all testimony and evidence adduced on the part of said petitioners and all other persons interested in the matter of said pro- posed vacation, and did take proof of the matters averred in said peti- tion, and being of the opinion that the prayer of said petition should be granted upon the terms hereinafter stated, did duly report its con- clusions to said Assembly, recommending the adoption of an appropriate resolution declaring such vacation; now therefore, it is hereby RESOLVED, By the Common Council of the City of St . Paul that Edmund street from Fairview avenue to Aldine street , also Charles street from Fairview avenue to Aldine street , Sherburne avenue from Fairview avenue to the easterly line of Lot 27 in Block 5 and the easterly line of Lot 4 in Block 8, of Dickerman Park, also Wheeler avenue from Uni- versity avenue to Thomas street, also all of the alleys in Blocks 1 , 2, 3 , 4, 6 , 7 and 8 , and the alley in Block 5 from Wheeler avenue to the easterly line of Lots 4 and 27 in said Block 5 of Dickerman Park Addi- tion to St . Gentlemen, - In the petition of Griggs - Cooper & Co. et al for the vacation of the Streets and alleys in Dickerman ?ark it is stated that "None of said described streets or alleys have ever been opened, graded or improved or used as public streets and the public will not suffer or be inconvenienced by such vacation. " As a matter of fact the streets within the limits of this addition were graded in 1891, there is a sewer in Charles St. from Fairview Ave. to Aldine St . and the water mains are in Charles St. and Sherburne Ave . between the same limits. For this reason it would appear that the public had.sorne interests in this tract described to be vacated. That he has made improvements on said lot consisting of a dwelling house in which he now resides with his family and that he has expended for said improvements betwee n Four Thousand and Five Thousand Dollars and that he bought the same from the Dickorr,'an Investment Company with the understand in ; and represen- tation that said Block Five would be devoted entirely to residence pro- perty which 4as an indlrce„'lent for him to buy and cause all of said costly ir.prove2lents . That if the Petition now before your Honorable body to vacate Sherburne Avenue , Charles Street and Edmund Street Between Faiririew Avenue and Aldine Street, should be acted on f avor- ably, it will not only make his residence on said lot five an undesirable place to live in but that it will depreciate in value at, least fifty per cent (5o ) and that he will therefore , be greatly prejudiced by the vacation of the said streets and allies and there- fore, protests `ra inst the granting of said Pet i.ti on and against the vacating of any said streets or any portion thereof and respectfully petions your Honorable body not to grant the same .
