The Drake Marble & Tile Company ,a corporation organized
under the laws of the State of "innesota ,and the Chicago Great
Western Railway Company ,a railway corporation ,the petitioners
herein ,allege that they are all of the owners of the property
on the line of the public street hereinafter described ,and which
your petitioners ask to have vacated .
Said petitioners hereby petition and pray that your
Honorable body vacate and discontinue all that portion of Custer
Street in the City of St .Paul ,Ransey County ,Minnesota ,described
as follows ,to-wit :
All that portion of Custer Street lying south of the
southerly line of Plato Avenue and north of a line parallel to
and ten feet southerly of the most southerly track of the
Chicago. Great Western Railway Company ,across Custer Street .
Said Custer Street being described on the plat of Test St .Paul
as Clay Street and designated on the plat of Custer Street
Addition to St .Paul as Custer Street ,being all that portion of
said Clay Street lying easterly of Block 170 in said West St .
paul ,and all that portion of said Custer Street lying on the 1
west side of said Custer Street Addition and bounded on the
north by said southerly line of Plato Avenue ,an d on the south
by a line parallel to and ten feet southerly of the most southerly
track of the Chicago Great Western Railway Company across
Custer Street .
Your petitioners further allege and show that no
portion of said street so proposed to be vacated has ever been
open ,used or traveled ; that the same is a cul de sac ; that the
sax.ae is wholly unnecessary as a street ; that there is no occasion
'
now and th re will be none in the future for the use of the same
as a publi street ,and that the public interest requires that
the same should be vacated as a street . That hereto attached is
