Paul, lying between a line beginning at the easterly corner of said alley and Short street and extending along the easterly line of said alley a distance of eighty feet, and a line beginning at the westerly corner of said alley and Short street and extending along the westerly line of said alley a distance of seventy feet, and a straight line connecting the southerly end of said last two mentioned lines , as shown upon said plat , be and the same is hereby vacated and discontinued as a public alley, subject , however, to the following conditions , that is to say: Such vacation is based upon the condition that said petition- ers shall, before this resolution takes effect , pay into the Treasury of said City the expenses of said proceeding; and in addition thereto said petitioners shall convey or cause to be conveyed to the City of St . Paul for use as a public alley the easterly twenty feet. of Lots three (3) and four (4) of said add ition, as shown upon said plat . Gentlemen : - Pursuant to instructions of the Committee on Streets of the Board of Aldermen, I transmit herewith a resolution vacating a portion of the alley in Ogden's Addition to St . Paul, on petition of Joseph A. Cox and others, the consideration being fixed at the expenses of the proceeding and the deeding of the easterly twenty feet of Lots 3 and 4 in said addition to the City for alley purposes. Very respectfully, 4 leCo „L,1-1-c _,,-tetv-e-e o o etti'on Attorney . 41 / STATE OF MINNESOTA ) (ss. • County of Ramsey ) To the Common Council of the City of St. Paul:- The undersigned, your petitioners , respectfully represent that they are the owners of a majority of the property abutting upon that certain alley lying between Lots 1 and 2, on the east , and Lots 3, 4 and 5 , on the west , in Ogden' s Addition to the City of St. Paul , of a platAwhich is hereto attached and made a part of this petition; that your petitioner, Joseph A. Cox, is the owner of Lot 2 abutting said alley on the east, under contract from Noyes Bros . & Cutler , (who are the fee owners thereof) , and the said Joseph A. Cox is .lso the owner of the easterly 20 feet of Lot 3 abutting said alley on the west , and is the owner of all of Lot 4 abutting said alley on the west ; that your petitioner, George Cogel , is the owner of the balance of said Lot 3 abutting said alley on the west , and your petitioner, Mrs . Keller, is the owner of Lot 5 abutting said alley on the west. And your petitioners respectfully pray that the Common Council vacate so much of said alley as lies between a lirie beginning at the easterly corner of said alley and Short Street and extending along the easterly line of said alley, a distance of 80 feet , and a line beginning at the westerly -corner of said alley and Short Street and extending along the westerly line of said alley a distance of 70 . feet , and a straight line connecting the southerly end of said last two mentioned lines ,) or so much of said alley as is included in the red ink lines shown on said plat hereto attached. And in consideration thereof , your petitioner , J o;-ieph A: Cox, hereby covenants and agrees that he will , in consideration of . such vacation within ten days after the same is so vacated, convey Jr ti r t , -2- to the City of St. Paul an easement for alley purposes in the easterly 20 feet of said Lots 3 and 4 as a substitute for said vacated portion of said alley; that the land herein proposed to be conveyed as a sub- -stitute for said alley, is indicated by red ink lines on the plat • hereto attached. The reason why said vacation is petitioned for and desired by your petitioners is that said Lbt 2, owned by the said Joseph A. Cox, has a narrow frontage of but 34.72 feet on Short Street , and said. Joseph A. Cox has built a home on said lot , fronting on Short street, at an expense of about 43700, and desires to increase the frontage of his residence property on Short Street 20 feet , and is willing to give in. lieu of said 20 feet of vacated alley for alley purposes , 20 feet of said Lots 3 •and 4 ; that by this arrangement , an alley as good for all practical purposes will he retained and the said Joseph A. Cox will be enabled to increase his frontage to 54.72 feet , thereby enabling him to improve his property and make a much more presentable appearance , and much handsomer premises than he now has.
