North, which lies between Lots 5 and 6 on the east and Lot 7 on the
west, on petition of Y. H. Reynolds and others, the compensation being
fixed at Fifty Dollars.

WHEREAS , The said Board of Aldermen deemed it expedient that
the matter therein referred to should be proceeded with and ordered said
petition and accompanying plat to be filed of record in the office of
the City Clerk of said City, and ordered said City Clerk to give notice
by publication in the official paper of said City in the manner and for
the time required by law, that said petition and the subject matter
thereof would be heard and considered by the Committee on Streets of
said Board of Aldermen at its regular meeting to be held in the Council
Chamber in the Court House and City Hall Building in said City on the
2nd day of August, 1906 , at four o' clock in the afternoon, which said
notice was duly published and given, and said Committee did meet at said
time and place and did then duly adjourn the hearing of said matter to
its regular meeting appointed to be held on the 16th day of Au -ust, 1906,
at four o' clock P. M. at the same place , as will more fully appear from
the records of the proceedings of said Committee; and
WHEREAS, Said Committee on Streets of said Board of Aldermen
did meet at the time and place last mentioned and appointed, pursuant to
said adjournment, for the hearing , investigation and consideration there-
of, and did then and there duly investigate and consider the matter of
said proposed vacation, and did then and there hear all testimony and
evidence adduced on the part of the petitioners and all other persons
interested in the matter of said proposed vacation, and did take proof

of the matters averred in said petition, and being of the opinion that
the prayer of said petition should be granted upon the terms hereinafter
stated, did duly report its conclusions to said Board of Aldermen,
recommending the adoption of an appropriate resolution declaring said
vacation ; now therefore , it is hereby
Resolved, By the Common Council of the City , f St . Paul that
all that part of the alley lying between Lots 5 and 6 on the east and
Lot 7 on the west, in Block forty-four (44) of St . Anthony Park North,
as shown upon the plat annexed to said petition, be and the same is
hereby vacated and discontinued as a public alley, subject, however, to
the following conditions, that is to say:
Such vacation is based upon the condition that said petitioners
shall, before this resolution takes effect, pay into the treasury of
said City the sum of Fifty Dollars ($50 .00) in addition to the expenses
of this proceeding, which is hereby fixed as the compensation to be paid
to said City in considerationof�said vacation .

We , the undersigned, owners of lots , , , , /44 -

and , respectfully request your honorable body to
vacate that portion of an alley which runs between lots 5 and 6 on the
east and lot 7 on the west , and from Knapp street to the alley north of
Lot 7, Block 44, St . Anthony Park, North Addition, in the City, of St . Paul,
County or Ramsey, State of Minnesota, according to the recorded plat
thereof on file in the office of the Register of Deeds in and for said
city, county and state above noted, for the reason that ,
The above alley not being used and never h! v ng been used for a
public highway or alley. This portion of the alley runs up a steep hill
and is never used as a highway. All the other alleys are on the level or
easy grades from the streets , a- d hence are used to the exclusion of the
alley-way which we desire to vacate . Block 44 is well supplied with alleys
otherwise . Closing this portion of the alley described will not affect
the alley rights of other property in the block .
There is one residence on lots 7 and 8, and -wo arc planning that
there shal]. be but one on lots 4, 5 and 6.
Use to be made of this alley if vacated is for shrubbery and
ornamental plantation.
