Gentlemen:-
Pursuant to instructions of the Committee on Streets of the
Board of Aldermen, I transmit herewith proper form of resolution vacating
that part of the Territorial Road lying between Aldine and Fry streets ,
which is not included within the lines of Blair street and the lines of
the alley between Fry and Aldine streets ; the compensation being fixed
at Ten Dollars .

The Committee on Streets of the Board of Aldermen at
their meeting held April 26th,1906, made favorable report on the
petition of H.W.Withee and others for the vacation of Territorial
Road between Aldine street and Fry street, naming as compensation,
the su:i of $10 .00.
I am in instructed to refer this matter to you with
the request that you draw up a proper form of resolution for the
vacation of said Road.

Dear Sir: -
As requested by you, I hand you herewith form of petition
for the vacation of Territorial Road between Aldine street and Fry* -
street . As you know, it will be necessary for a majority of the owners
of property on the line of the proposed vacation to sign this petition;
also that one of the petitioners should verify the petition before a
Notary Public .
It will be necessary also to have a plat or diagram attached
to the petition showing the portion of Territorial Road desired to be
vacated .

hereinafter stated, did duly report its conclusions to said Board of
Aldermen, recommending the adoption of an appropriate resolution declar-

ing said vacation; now therefore , it is hereby
Resolved, By the Common Council of the City of St . Paul,
that all that portion of said Territorial Road in the City of St . Paul,
Minnesota, lying between Aldine street and Fry street , annd of included

within the lines of what is now known as Blair street , or^ 6he lines of
the alley between Fry and Aldine streets , as shown upon the plat annexed
to said petition, be and the same is hereby vacated and discontinued
as a public street, subject , however, to the following conditions , that
is to say :
Said vacation is based upon the condition that said petition-
ers shall , before this resolution takes effect , pay into the Treasury of
said City, the sum of Ten Dollars 010 .00) in addition to the expenses
of this proceeding, which is hereby fixed as the compensation to be paid
to said City in consideration of such vacation .
