Foot and others, the owners of a majority I of the land and property abutting upon and adjoining the alley hereinafter de- scribed, praying for the vacation of that � certain strip of land twenty feet in width ` in front and adjoining lots one, two and s^ three of Borup's Addition to St. Paul, Minnesota, between Cooper street and Temperance street, which was conveyed by Elizabeth Borup on Dec. 22, 1S63, for' an alleyway, and more ,articularly de-1 WHEREAS, There was heretofore pre s enl scribed and shown upon the plat an- nexed to said petition, which said petition is duly verified as required by law and sets forth the facts and reasons for such Aldermen, one of the branches of the Common C01vacation; and Whereas, the said Board of Aldermen deemed it expedient that the matter St . Paul the petition of Bert I . Foot and Oth(therein referred to should be proceeded p with, and ordered said petition and ac- companying plat to be filed of record in the office of the City Clerk of said city, majority of the land and property abutting upor and ordered said Clerk to give notice bs"ey publication in the official paper of said city, in the manner and for the time re- qulred by law, that said petition and the hereinafter described, praying for the vacatiorsubject matter thereof would be heard and considered by the Committee on Streets of said Board of Aldermen, at its regular meeting, to be held in the Council of land twenty feet in width in front and adj o.Chamber in the Court House and City . Hall Building in said city, on the 27th day of July. 1905. at four o'clock in the after three of Borup ' s Addition to St . Paul Minnesolnoo , and said committee did meet at said e.t time n and place, and did duly adjourn the hearing of said matter to a regular meet- ing of said committee to be held at the \ and Temperance street , which was conveyed by E-same place on the 15th day of August, 1fA6, s,t four o'clock p. m., and Whereas, the said Committee on Streets of said Board of Aldermen did meet at December 22nd , 1863 , for an alley-way , and mori the time and place last mentioned and la appointed, pursuant to said adjournment, for the hearing, investigation and consid- and shown upon the plat annexed to etltlieration thereof, and did then and there p p p duly investigate and consider the matter' annexe o said of said proposed vacation, and did then and there hear all testimony and evidence is duly verified as required by law and sets fianduall on the part of the petitioners 30n5 and all other persons interested in the matter of said proposed vacation, and did take proof of the matters averred in for such vacation; and said petition, and being of the opinion that the prayer of said petition should he granted upon the terms hereinafter stated, did duly report its conclusions to WHEREAS , The said Board of Aldermen 'said Board of Aldermen, recommending iLt the adoption of an a'nropriate resolu- tion declaring said vacation; now, there- the matter therein referred to should be prose fores ed, by the Common Council of the City of St. Paul, that all of that cer- tain strip of land, twenty feet in width, said petition and accompanying plat to be file in front of and adjoining lots one, two LCe and three of Borup's Addition to St. Paul, Minnesota, between Cooper street and Temperance street, which was conveyed of the City Clerk of said City) and ordered sa by Elizabeth Borup on Dec. 22, 1853, fore an alleyway, as shown upon the plat an- nexed to said petition, be and the same by publication in the official paper of said C is hereby vacated and discontinued as a public alley, subject, however, to the following terms and conditions, that is to say: for the time required by law, that said petit' Suehvacationisupontheconditionthat•er. said petitioners shall, before this resold-' tion Sakes effect, pay into the Treasury of said city the sum of five dollars ($5) thereof would be heard and considered by the C in addition to the expenses of this pro- ceeding, which is hereby Fixed as the compensation to be paid to said city in consideration of said vacation. said Board of Aldermen, at its regular meeting s pdopted905y the Board of Aldermen 1Cil Adopted by the Assembly Oct. 19, 1905. Paul, that all of that certain strip of land , twenty feet in width, in front of and adjoining Lots one , two and three of Borup ' s Addition to St . Paul, Minnesota, between Cooper street and Temperance street , which was con- veyed by Elizabeth Borup on December 22nd, 1863 , for an alley-way, as shown upon the plat annexed to said petition, be and the same is hereby vacated and discontinued as a public alley, subject , however, to the following terms and conditions , that is to say: Such vacation is upon the condition that said petitioners shall, before this resolution takes effect , pay into the Treasury of said City the sum of Five Dollars ( 55) in addition to the expenses of this proceeding, which is hereby fixed as the compensation to be paid to said City in consideration of said vacation . Gentlemen: The undersigned *the owners of Lots and 44,, of Borup's Addi- tion to. the.City of St.Paul , located between Temperance and Cooper Str644ts on6;("T .* 'Street. On December 22 , 1863 , Elizabeth Borup then the owner of this property by Quit Claim Deed conveyed a strip 20 ft. in width adjoining. to and in front of Lots 1 , 2 and 3 of Borup' s Addition to St.Paul and extending from Cooper Street to Temperance Street for an alley-way. This alley has never been opb-i- eded and is of no use whatever for an alley. That since the givim of said Quit Claim Deed and more than 15 years ago buildings were constructed on said Lots 1 , 2 and 3 by the owners thereof , which buildings extend over and are situated partly on the Lots 1, 2 and 3 and partly on said alley as shown on plat hereto attached. Your petitioners would therefore respedtfully petition the Hon. Council that this alley may be vacated and that the said City Release and quit ClafAt to the respective owners of said Lots 1, 2 and 3 their proportionate share of said alley and your petitioners will ever pray. 7 St.Paul , Minnesota, thus 29th day of -,- , 1905.
