T. Bass ' Subdivision of Lots 13, 14 and 15 of 13 Collins' Outlots in the City of St. Paul, Minnesota, lying between 14 Lots 13, 14, 15 and 16 on the east thereof and Lots 17, 18 and 19 on 15 the west thereof, in said Block one (1) , as shown upon the plat annexed 16 to said petition, be and the same is hereby vacated and discontinued , 17 as a public alley, subject however to the following terms and conditions, 1g that is to say: 19 Such vacation is upon the condition that said petitioner 20 shall, before this resolution takes effect, pay into the treasury of 21 said City the sum of Fifty Dollars ($50.00) in addition to the expenses 22 of this proceeding, which is hereby fixed as the compensation to be 23 paid to said City in consideration of said vacation. Your petitioner, Jacob Firestone, respectfully shows that he is a resident and citizen of the City of St. Paul, Ramsey County, U.inne- sota, and that he is and for more than ten years last past has been the owner of those certain pieces or parcels of land situated In the County of Ramsey, State of Minnesota, to-wit :- Lots number twelve (12) to nineteen (19) inclusive in Block S , number one (1) of J. W. Bass's Subdivision of Collin 's Out Lots , Lots No. 15 , 14 & 13 South of the C . St .P. M. & 0 . R . R. , according to the 6WAT( " plat thereof on file and of record in the office of the Register of Deeds of said Ramsey County, and -rat said lots are the only lets front- Ong on the alley sought by your petitioner to be vacated; that a true fr sand correct copy of the plat of Block one (1) of said addition is hereto . ttach d and ishereby made a part of this petition and said plat in_- 0 , V dicates es all lots in said Block one (1) and the dimensions thereof, and 5)4 the streets bounding the same and the alley running through the same and the portion of the alley sought to be vacated as prayed in this petition, and said plat is true and correct in all particulars as to all things indicated thereon. Your petitioner shows that that portion of the alley in said block abutting on Lots thirteen (13) , fourteen (14) , fifteen (15) , sixteen (16) , seventeen (17) , eighteen (18) and nineteen (19) , Block one (1) in the addition above named has never been used for the purpose of a public alley although the same has been dedicated to the public for such purpose; that the northern end of said alley abuts on the right of way of the Chicago , St. Paul, Linneaholis Omaha Railway and that there is no necessity for A public alley leading to said point on said railway right of way and that the portion of said alley lying north of the south line of Lot thirteen ( 13) extended west- erly across said alley is of use or advantage to no one other than your petitioner.
