Heron and others, the owners of all the property and land abutting upon and adjoining that portion of Morrison street and Robert Court, formerly Wright street , hereinafter mentioned and described, praying for the vacation and discontinuance of said Morrison street between the northeast line of Livingston avenue and the south- west lineoff South Robert street, and of Robert Court , formerly Wright street, between the north line of Morrison street and the south line of Eaton & Morrison' s Addition, all in the City of St. Paul, Minnesota, and more particularly described and shown upon the plat consisting of two sheets annexed to said petition, which said petition is duly veri- fied as required by law and sets forth the facts and reasons for such vacation, and WHEREAS , The said Assembly deemed it expedient that the matter therein referred to should be proceeded with and ordered said petition and accompanying plat to be filed of record in tp office of the City Clerk of said City and ordered said Clerk to give notice by publication 11 the official paper of said City in the manner and for the time required by law, that said petition and the subject matter thereof would be heard and considered by the Committee on Streets of said Assembly, at its regular meeting to be held on the 4th day of January, 1904, at four o'clock P. M. of that day, at the Council Chamber in the Court House and City Hall Building, in said City, to which said Committee said matter was duly referred for hearing and re- port thereof, and thereupon said petition and plat were duly filed in the office of said City Clerk and said notice was duly given and pub- lished as required by law, and WHEREAS , The Committee on Streets of said Assembly did meet at the time and place above mentioned and appointed for the hearing, investigation and consideration thereof, and did then and there duly investigate and consider the matter of said proposed vacation and did 1 1 2 3 4 STATE OF MINNESOTA, ) 5 ) SS. 6 County of Ramsey. ) George S. PAUL: We, the undersigned, being all of the owners of all the property intended to be rearranged as hereinafter stated and of all the property fronting upon the streets hereinafter named which we desire to have vacated, respect- fully represent and petition as follows: All of the property in blocks one (1) two (2) eight (8) and nine (9) of Eaton and Morrison' s Addition to West St . Paul is now so awkwardly laid out and platted that it is impossible to utilize the same to advantage. By agreement between the undersigned it has been agreed to rearrange the property in said blocks between south Robert Street and Livingstone Avenue substantially in accordance with the plat hereto attached and made a part hereof; the red lines on said plat indicate substantially the lines of the lots as the same will be after said rearrangement is complete. The white lines on said plat indicate the lots and street lines as originally platted. Since Raton and Morrison' s Addition was originally platted the streets between blocks one (1) and two (2) have been vacated and Livingstone Avenue has been opened and extended through blocks one (1) ten (10) and nine (9) as indicated on said blue print . Morrison Street from the northeast line of Livingstone Avenue to the southwest line of south Robert Street and Robert Court from the north line of Morrison Street to the southerly line of Raton and Morrison' s Addition at present serve the lots abutting thereon and which it is proposed by the owners thereof to rearrange as above indicated. The established grade of south Robert Street where the same crosses Morrison Street is about twelve (12) or fifteen (15) feet above the level of Morrison Street and neither of said streets serve any purpose for the public but only serve as a way of access to said lots and neither of said streets are in any way improved or graded.
