In the Matter of the Petition and Proceedings
to vacate that part of Eva Street in Morrison' s
Addition to West St . Paul 'yin- between Blocks
Eleven and Nineteen in said Addition and ex-
tending from Eaton Avenue to the center of
O'Dell Creek.
WHEREAS there had been presented to the Board of Aldermen
one of the branches of the Common Council, of the City of St . Paul,
a petition by North Western Fuel Co. , and Chicago and Great Western
Railway Co. , the owners of all cf the land on the line of and
adjoining or abutting on either side of that part of Eva Street in
Morrison' s Addition to West St. Paul lying between Blocks Eleven and
Nineteen in said Addition and extending from Eaton Avenue to the
center of O'Dell Creek, praying for vacation of that portion of the
above named street here i nbefore described and set ,ig forth fully
the facts and reasons for such vacation accompanied by a plat of the
portion of said street set to be vacated and of the adjoining prop-
erty and duly verefied by the oaths of one of the petitioners.
WHEREAS the Board of Aldermen deem it to be expedient that
the natter of said vacation shall be proceeded with.
Now, therefore, be it resolved and hereby ordered that
said petition he filed of record with the City Clerk of the City of
St . Paul, who is required to give notice by publication, in the man-
ner and form and for the length of time provided by law, of a hear-
to be had in the premises by the cor iittee on streets of .1:11e
Board of Aldermen on a day and at a place to be therein specified.

WHEREAS, There was heretofore presented to the Board of
Aldermen, one of the branches of the Common Council of the City of
St. Paul, the petition of the Northwestern Fuel Company and the Chicago
Great Western Railway Company, the owners of all of the property upon
the line of and abutting upon both sides of that portion of Eva street
hereinafter described, praying for the vacation of all that portion of
Eva street, in the City of St. Paul, Minnesota, lying and being between
Blocks numbered eleven (11) and nineteen (19) in Morrison' s Addition to
West St . Paul, in said City of St. Paul, and extending from Eaton
avenue to the center of O'Dell Creek, and more particularly described
and shown upon the plat annexed to said petition, which said petition
is duly verified as provided by law, and sets forth the facts and
reasons for such vacation; and
WHEREAS, The said Board of Aldermen deemed it expedient that
the matter therein referred to should be proceeded with, and ordered
said petition and accompanying plat to be filed of record in the office
of the City Clerk, and ordered said Clerk to give notice by publication
in the official paper of said City, as required by law, to the effect
that said petition had been filed, and stating in brief its object and
that said petition and the subject matter thereof would be heard and
considered by the Committee on Streets of said Board of Aldermen at
its regular stated meeting to be held in the Council Chamber of the
Court House and City Hall building in said City of St. Paul, at four
o'clock P. M. on the 2nd day of July, 1903, and thereupon said petition
and plat were duly filed in the office of said City Clerk and said
notice was duly given and published as required by law, and said peti-
tion, plat and all matters connected therewith were duly referred by
said Board of Aldermen to said Committee on Streets for hearing, in-
vestigation, consideration and report; and
WHEREAS, Said Committee on Streets of said Board of Aldermen,
did meet at the time and place above stated and appointed therefar for
