Approved 190 • • \ \;\7 SI\1() • • • • WHEREAS, it appears that the board of public works , under the directions of the board of park commissioners, has completed the necessary steps and proceedings looking to the appropriation and condemnation of certain land within the limits of the city of St . Paul for use by the public as a public park to be known as Phalen Park ; and WHEREAS, it is , in the opinion of the common council, both desirable and urgent that all of the streets and avenues with- in the limits of the said Phalen Park should be placed under the jurisdiction of the said board of park commissioners for park pur- poses, and for those alone; and WHEREAS, the said board of park commissioners has request- ed that those portions ofka. ComdViPhalen avenue and Earle street which are within the limits of Phalen Park, so called , should be vacated and discontinued as public streets and set apart and, placed under the jurisdiction of said board of park commissioners for park purposes forthwith: NOW THEREFORE, Be It Resolved , that the common council of the city of St . Paul deems it expedient that the matter of the re- quest of said board of park commissioners be proceeded with not- withstanding no formal petition has been filed asking for said va- cation for the reason that the city of St . Paul is the owner of the land abutting upon said treets within the limits of said Phalen Gam✓ SIa� ..�. This resolution was referred to this department by your committee upon the suggestion of the pres- ident of the Board of Park Commissioners that the portions of the streets referred to ought perhaps rather to be vacated and discon- tinued than placed under the jurisdiction of the park board. A'v F No. 9692—By Mr. Craig— Whereas, There was heretofore present- ed to the Assembly. one of the branches of the Common Council of the City of St. Paul, a petition on the part of the Board of Park Commissioners, praying for the vacation of those portions of Lake •Ccmo and Phalen avenue and Earl street, which are within the limits of Phalen Park, so-called, which said petition brought forth the facts and reasons for such vacation, and was accompanied by a plat of the portion of the streets pro- posed to be vacated, as he:eirbe-fore re- cited, and the ground adjoining thereto, and was duly verified as required by law; . and Whereas, the said Assembly deemed it expedient that the matter therein re- cited should be proceeded with, ordered •said pctitie•n to be filed of record by the "" City Clerk, and to give notice by publi- cation in the official paper of said city to the effect that said petition had been filed, as aforesaid, and stating in brief its object, and that said petition would be heard and eonsidered by the Assembly on the 21st day of March. 1901, at 7:35 o'clock in the afternoon of that day in the council chamber in the Court House, in the City Hall Building, in the City of St. Paul. County of Ramsey and State of Minnesota, at which time and place the said Assembly will investigate and con- cider the matter of said vacation and will hear the testimony and evidence to be adduced on the part of the persons in + terested therein; and .
