TION.
For the Vacation of That Portion of
Olive Street, Situate in Kittson's E R K S OFFICE
Addition, St. Paul, Lying Between
the South Half of Block 63 and the
South Half of Block 62.
Notice is hereby given, pursuant to law
and to the resolution of the Board of
Aldermen Common Council of said city,body z
a petition for the vacation of that portion fu�_'/'GGT 17i�G
of Olive street, situate in Kittson's addi-
tion to the City of St. Paul, lying be-
tween the south half of block Sixty-three ;
(63) and the south half of block sixty-
two (62), as shown by plat annexed, has
been filed in the office of the City Clerk
of the City of St. Paul, Minn., in and by
which said petition the reasons assigned
for such petition and request are: the '722' Resolution of the Common Council, approved
desire and purpose of said petitioner of '
removing and tearing away the buildings •
situate upon the south half of block 63 of
said Kittson's addition, and the freight
house situate upon the south half of blocks
64 and 65, and rebuilding in place thereof •
• a freight house extending over and across
lot 7 and lot 8 of block 62, and over and •
across the south half of block 63, extend-
, ing said freight house along and ad-
jacent to Third street, so that tracks and
facilities may be used upon the balance
_of said property for the handling and
storing of cars and the shipment and
loading of freight; that the buildings sit-
uat e-now upon the south half of block
63 practically covers all of the space of
ground of said south half,and leaves the
said petitioner, the Wisconsin Central
Railway company, no opportunity or no
space upon which to operate tracks for
the handling of its said freight; also that
that portion of Olive street lying north
of the south half of Blocks 62 and 63, and
extending to Fourth street, has been
vacated and is occupied.
Pursuant to law and the said resolu-
tion of the Board of Aldermen above re-
ferred to a adopted, the said petition I
will be heard and considered by the com-
mittee
on streets of the Board of Alder-
men of the Common Council of the\City
of St. Paul, on the 1st day of March,
A. D. 1900, in the council chamber in the
court house in the City of St. Paul, Coun-
ty of Ramsey, Minn., at 4 o'clock p. m.
on said day, at which time and place the
said committee on streets will investigate
and consider the matter of such vaca-
tion, and hear the testimony and evi-
dence on the part of the parties interest-
ed.
A. copy of said resolution above men-
tioned is hereto attached and published
herewith, as part of this notice.

In the matter of the vacation of that portion of Olive St.,
situate in Kittson's Addition to t:•ie city St. p a.l, lying between . e
South half of Block 63 and the South half of Block 62. Now crimes your
petitioner, the Wisconsin Central Railway Company a:. d respectfully
represents to the Corson Council of the City of St. pauli
That it is a corporation duly created, organized a-. :'_ exis,
ting under and by virtue of the laws of the state of Wisconsin with
principal offices at Milwaukee, Wisconsin, and as such ,orporation is
engaged in the operation of a line of railway extmld.in g from Chicago
to the city of St. Paul and city of Minneapolis, and a.s such ^oxoraar-
tion is obliged to mOntain and keep freight houses anet ware houses
at said city of St. Paul.
The said corporation, the Wisconsin Central Railway Company
is the omer of lots seven (7) and eight (8) in Block 62 of Kittson's
Addition to St. yaul; thEt it is also the owner of all of the South
half of Block 63 of said Kittson's Addition and is also the owner of
Blocks 64 and 65, 66 and 67 and other property, all of which said pro,
prty described is railroad property used by said railway company for
terminal purposes, warehouses, freight houses add storing and handling
of oars, and delivery and handling of freight; tLat no one bs any iri-
terest in the property mentioned and described above, except t?-e, YIs,
cons in Central Railway Company, and that of all property abutting
upon said Clive Street which this arplication is to 1 aor.,te is owned
by the said Wisconsin Central Railway Company; that the object and
purpose of the za cation of said Olive St., is for the purse of re,

Whereas, there was heretofore pre-
sented to the Board of Aldermen, one of
the bodies of the Common Council of the
City of St. Paul, a petition of a majority
of the property owners along that portion •
of Olive street lying between the south I
half of block 62 and the south half of
block 63 of Kittson's Addition to the City
of St. Paul, which petition presented and -
brought forth the facts and reasons for
such vacation, and was accompanied by
a plat of the portion of the street pro-
posed to be vacated, and the adjoining
ground, and was duly verified, as was
required by law; and,
Whereas, said Board of Aldermen deem-
ing it expedient that the matter therein
should be proceeded with ordered said
pgtition to be filed of record by the said t
Clerk of the City of St. Paul, and or- 1
dered said City Clerk to give notice by
publication In the official paper of said 1
city to the effect that said petition had
been filed as aforesaid, and stating in
brief its object, and that said petition
would be heard and considered by the
Committee on Streets of the Board of 1
Aldermen of the Common Council of the
City of St. Paul on the let day of March, '
A. D. 1900, at four o'clock p. m. on said
day, in the Council Chamber in the Court
House in the City of St. Paul, at which
time and place said Committee on Streets
would investigate and consider the mat-
t ter of said vacation and hear the'testi-
mony and_evidence on the part of the
`parties interested; and,
Whereas, said petition was in fact duly
.filed, such notice duly given and said
resolution duly complied with in all par-
ticulars; and,
■ Whereas, at said time and place said
Committee on Streets did investigate and
consider said matter and hear all testi-
j mony and evidence on the part of the
parties interested, and thereupon, and
after hearing the same, said Committee
!on streets has reported to the Board of
i Aldermen in favor of granting said pe-
a tition;
Now, therefore, be it resolved, That
the Board of Aldermen, the Assembly
concurring, hereby concurs in the report
,,of its Committee on Streets herefnabove
referred to, in the matter of granting the ,
prayer of said petition for the vacation
,of said portion of said alley; and further,
Be it resolved, That that portion of
Olive street so described, to wit: all that '
portion of Olive street lying between the
south half of block 62 and the south
half of block 63 of Kittson's Addition to
the City of St. Paul be and the same is
hereby vacated; and further,
Ba It resolved, That the amount to be
paid into the City Treasury by the per-
sons desiring such vacation, before said
portion of said street shall be vacated, be f
fixed at the sum of fifty dollars ($50).

Herewith, please find returned Board file No.11414 , which
is the resolution providing for the vacation of a certain portion
of Olive street .
This was referred at the meeting of your committee on
March 12th last , to this department , with the request that we report
"as to the legal status of the property" .
In conversation with Mr. Thompson, one of the members of
your committee , I understand that what the committee desired, was an
inquiry into the title of the property , so far as it might have been
affected by general taxes or city assessments, and in this connec-
tion I have the honor to report as follows :
There are no general taxes unpaid, so far as lots 7 and 8
in block 62, jand 8 in block 63, Kittson' s Addition, are concerned .
All the taxes against this property having been paid , 5s I have been
given to unr3erstand , at the time of the reorganization of the Wis-
consin Central Railway Company, the petitioner for this vacation.
So far as the city assessments are concerned, however, the
situation is different . The City Treasurer reports to me that there
are assessments outstanding , which, with interest , amount , in a to-
tal , to $62.48 . This item covers all four of the lots in question.
I find also from an examination of the records that lot 8 in block
63, was assessed , in 1875 , for the grading of Third street from

Broadway to the railway tracks, in the sum of $61'.25 . The applica-
tion for judgment on this assessment , when it became delinquent ,
w`as denied , and a reassessment was ordered . The application for

judgmenV' on that re-assessment , when it br=came delinquent , was also
denied, according to the City Treasurer' s books , and after that I
find nothing of any sort in the records . I apprehend that this
assessment of $637.25 , has, in all probability , been lost to the
city by lapse of time .
Mr . McDonald , the attorney for the Minnesota mransfer
Railway Company , informs me that the other item of $62 .48 , will be
paid some tine during today . If this is done , there will be nothing
in the way of valid taxes or assessments outstanding against the
property .

- situate in Kittson' s Addition to the City of St. Paul, lying .between the
south half of Block 66, and the south half of Block 62.
Now comes your petitioner, The Wi ,consin Central Railway Com-
pany, and respectfully represents to the Common Council of the City of
St . Paul:
That it is a corporation duly created, organized and existing
under and by virtue of the laws of the State of Wisconsin, with principal
office at Milwaukee, and as such corporatin is engaged inthe operation of
a line of railway extending from Chicago to tLe City ofst. Paul and the
City of Minneapolis, and as such corporation is obliged to maintain and
keep freight houses and warehouses at said City of St. Pat:l.
The said corporation, the Wisconsin Central Railway Company, is
the owner of Lot 7 and Lot 8, in Block 62, of Kittson' s Addition to St.
Paul ; that it is also the owner of all of the south half of Block 63 of
said Kittson's Addition qnd is also the owner of the south half of Blocks
64, 65, 66 and 67, and of other property, all of which said property de-
scribed is railroad property used by said Railway Company for terminal
purposes, warehouses, freight houses and the storing and handling of cars
and the delivery and handling of freight; that no one has any interest in
the property mentioj,ed and described above, except the Wisconsin Central
Railwa Company, and that all of the property abutting upon said Olive
Street, which this application is to vacate, is Owned by the said Wiscon-
sin Central Railway Company.
That the object and purpose of the vacation of said Olive
Street, is for the purpose of removing and tearing away the buildings
situate upon the south half of Block 63 of said Kittson ' s Addition, and
the freight house situate upon the south half of Blocks 64 and 66, and
rebuilding-An place thereof a freight house extending over and across Lot
7 and Lot 8 of Block 62 and over and across the south half of Block 63,
extending said freight house along and adjacent to Third Street, so that
tracks and facilities may be used upon the balance of said property for
the handling and storing of cars and the shipment and loading of freight;
that the buildings situate now upon the south half of Block 63, practical-
ly cover all of the space of ground of said south half, and leaves the

said Wisconsin Central Railway Company no opportunity or no space upon
which to operate tracks for the handling of its said freight ; that the
map _of said property is hereto attached and made a part of this appli-
cation.
Your petitiner would further represent that that portion of
Olive• Street lying north of the south half of Blocks 62 and 66, and ex-
tending to Fourth Street, has been vacated and is occupied by buildings
of the Chicago, St. Paul, Minneapolis & Omaha Railway Company and also by
buildings and frei, ht house of the Minneapolis & St. Louis Railway Com-
,;any and the Northern Pacific R.R . Com any, so that there is no chance
for travel over and upon that portion of Olive Street asked to be vacated
by this petitioner .
WHEREFORE, your petitioner respectfully prays that the Common
Council of the City of St. Paul vacate that portion of Olive Street lying
between the south half of Block 62 and the south half of Block 66, in the
manner provided by law, and your peti ' oner will ever pray; .
