ADMINISTRATIVE ORDER, That as Hoffman Electric Co. of St. Paul is currently
performing work for the Department of Community Services known as "1974 Area
Lighting for Hockey and Skating Areas - Job #74-34", and
WHEREAS, the specifications in Section GC-12 thereof
provide that "no payment will be made for material delivered to the site and not
incorporated, in the work, unless specifically fabricated for the job, in which
case consideration may be given to the labor and material required for fabrication" ,
and
WHEREAS, this paragraph is a waiveable right that is
vested in the City and as to Job #74-34 has created an inequitable situation as
regards Hoffman Electric Company who has purchased substantial equipment and
fixtures as part of the project but cannot be paid for same because of Section
GC-12, therefore it is
ORDERED, that the proper city officials are hereby authorized
and directed to pay the Hoffman Electric Company the sum of $ &,�in partial
payment on said contract. poo
