OFFICE OF THE MAYOR / No: ADMINISTRATIVE ORDER MAR 2 0 1975 Date: • ADMINISTRATIVE ORDER, UPON THE FOREGOING, it is hereby declared that an emergency exists which requires immediate action to protect persons and property from the dangerous condition that reasonably could occur due to damage to the City' s sheer fence and the east bank pier from flood waters, and also to protect the sheer fence and the pier from damage due to the flood waters, THEREFORE, the Purchasing Agent of the City of Saint Paul is hereby author- ized and directed to award a contract to Twin City Shipyard, Inc. for the repair of the sheer fence for the sum of $11,000.00, said company to furnish such bonds and insurance as required by law and by the City and such contract to be awarded without the necessity of advertising for bids. Cost to be charged to P. T.R. Fund Code 60,000 and to be reimbursed from the Public Works Contingency Fund. Stat. Section 471.345 and authorizing the City Purchasing Agent to award a contract to Twin City Shipyard, Inc. , 1303 Red Rock Road, St. Paul, Minn. , for the repair of a sheer fence structure protecting the Robert Street Bridge pier on the east bank of the Mississippi River. WHEREAS, the upstream portion of the City' s sheer fence was torn out by a barge in June, 1974 along with an adjacent section of sheer fence belonging to the Chicago & Northwestern Transportation Company, and repair of the City' s sheer fence was not feasible or practicable until the Chicago & Northwestern Transportation Company' s fence was repaired, and WHEREAS, on or about March 15, 1975, the Chicago & Northwestern Transpor- tation Company awarded a contract to Twin City Shipyard, Inc. for the repair of the sheer fence and such repairs are to begin during the week of March 23, 1975 and to be completed in approximately one week, and WHEREAS, the Bridge Department of the Department of Public Works believes that flooding of the Mississippi River will occur shortly after April 1, • 1975 and that such flooding will result in further damage to the sheer fence and damage to the unprotected Robert Street pier on the east bank of the river, and WHEREAS, the City has received a bid from Twin City Shipyard, Inc. to repair the sheer fence at a cost of $11,000.00 if such repairs are done in conjunction with the repairs on the Chicago & Northwestern, Transpor- tation Company' s fence, and it appears that said cost is reasonable and within the range of estimates made by other persons specializing in bridge repair, and WHEREAS, the time required to advertise for bids for the repair work to the City' s sheer fence would extend into the first week of April, and such delay would prevent the fence from being repaired until the flood waters recede, APPROVED AS TO FORM �a Q L- AJ" Assistant City Attorney Department Head Date Administrative Assistant to Mayor
