03-365Q � 3 v i ����1� Presented By Referred To Council File # n� � 3 (t� Green Sheet # ° 1� O �l y � RESOLUTION CITY OF SAINT PAUL, MINNESOTA a3 � Committee: Date 2 WHEREAS, on November 27, 2002, in Council File No. 02-1116, the Council of the 3 City of Saint Paul duly adopted a resolution approving a moratorium of limited duration for the 4 purpose of studying land uses in the Sunray area; and WHEREAS, on December 26, 2002, in Council File No. 02-1115, the Council of the City of Saint Paul, in compliance with the City Charter, also duly adopted a finalized interim ordinance establishing the proposed study of land uses in the Sunray area: 10 WHEREAS, the Council desires now to amend Council File No. 02-1115 to the extent 11 necessary to enable the developers of a proposed Cub Foods grocery store to move forward with 12 their various zoning and building applications which would otherwise be prohibited under the 13 terms and conditions set forth in Council File No. 02-1115; and 14 15 16 17 18 19 20 21 22 23 24 25 26 WHEREAS, a commercial use of the type proposed by the Cub Foods developers is a desirable land use within the present and future context of land uses in the Sunray Area; and WHEREAS, the Council is further advised that the proposed Cub Foods grocery store will require that certain existing businesses must relocate in order to accommodate the size of the proposed grocery store; and WHEREAS, the Council desires that any of the said existing businesses, who desire to relocate may be able to do so without the need to obtain separate exemptions from the interim ordinance established in Council File No. 02-ll5; NOW, THEREFORE, � R�G4�� O3-��s SOLVED, that Council File No. 02-1115 shall be immediately amended so that 3 its provisions shall not prevent the proposed Cub Foods grocery store developers from applying 4 for and, if approved, receiving any zoning or building permits necessary to undertake the 5 construction of their proposed development; AND, 6 7 BE TI' FLTRTHER RFSOLVED, that Council File No. 02-1115, shall also be amended to 8 provide that its provisions, as they may affect any presently operating business that must be 9 relocated as a part of the Cub Foods grocery store development, that these businesses may also 10 apply for and, if approved, receiving any zoning or building permits necessary to undertake 11 construction in a new location within the Sunray Shopping Center.
