ADMINISTRATIVE ORDER, Section 132, General Warranty of the Special Provisions
provides for the purposes of enforcing the provisions of all guarantees incumbent
upon the Contractor the retention of a reserve amount for the period of one year
from the date of the final estimate, and
WHEREAS, The entire physical work on the contract was completed well over one year
ago, although the one year period from the date of final estimate has, as yet, not
expired, it is hereby
ORDERED, That the reserve amount withheld on the following listed project less any
amount due the City by the Contractor as a result of this project, be released at
this time,

FURTHER ORDERED, That the five year guaranty of Magnolia Avenue from Walsh Street
to Weide Street, as described in Arcon Construction Company, Inc. 's certified letter
of October 23, 1972, is one of the conditions of this Administrative Order;
FURTHER ORDERM, That this Administrative Order shall have no force or effect unless
the Contractor provides a Five Thousand and no/100 ($5000.00) Dollars Maintenance
Bond to guarantee performance of the terms of Arcon Construction Company, Inc. 's
certified letter of October 23, 1972. The original of the Maintenance Bond shall be
filed with the City of Saint Paul Finance Director.

Dear Mr. Koenig:
• We have in the past months replaced bituminous surfacing
on Magnolia Street from Walsh to Weide; for reasons unknown
at this time there has been settlement over, the sewer
trench in this area. In lieu of excavating this street
area we hereby guarantee this street surface for a period
of five (5 ) years. If at any time during this period
the street settles, due to the sewer installation, Arcon
Construction Co. , Inc. will replace the same at their
cost .
