D279 White — City Clerk CITY OF ►SAINT PAUL •► Pink — Finance Dept. NO: Canary— Dept. aV OFFICE OF THE MAYOR Date: ADMINISTRATIVE ORDER ADMINISTRATIVE ORDER, WHEREAS, Jerome E. Maruska, an employee of the Department of Public Safety, Bureau of Police, was injured in a third party accident on August 29, 1971 , while engaged in the performance of his duties; and WHEREAS, the City has incurred medical expense in the amount of $364.40 thereof, and said employee was disabled from work for a period of time being paid salary in the amount of $525.85 for which the City may claim credit at the rate of $80.00 per week; and WHEREAS, a compromise settlement has been negotiated between said employee and the other party involved in said accident, which provides for a net settlement to the City in the amount of $593. 50 after deductions for proportionate attorney' s fees and costs; and WHEREAS, the amount due and owing said employee' s attorney, Robert Tolaas, and the City is all included in one draft in the amount of $890.25, receipt of which is hereby acknoAedged; and • WHEREAS, separate drafts for all the parties concerned are not easily obtainable and because of this, the City has agreed to the disbursing of the funds; now, therefore, be it ORDERED, that the proper City officers are hereby authorized to accept the sum of $593. 50 in full, final and complete settlement of its claim herein; that of said sum, $208.00 is thereby credited to the Police Salary Fund and $385. 50 to the Workmen' s Compensation Fund; and be it FURTHER ORDERED, that the proper City officers are hereby authorized to remit to Robert Tolaas the remaining balance of the draft of $890. 25, that being the sum of $296.75; and be it FURTHER ORDERED, that Administrative Order No. D-257, approved November 2, 1972, is hereby rescinded in its entirety.
