That Ordinance No. 5840, approved July 7, 1922, as amended, be and the same is hereby further amended(o as to rezone the following described property from "C" Residence District to Commercial District: Lots 7, 8, 9, Block 7, Wifelburg Hills Addition.) This property is located adjacent to the south side of Hawthorne between Rice and Park. This letter also deals with the application of Lawrence and Leonard Steiner for an appeal to establish a new building line on Hawthorne. It affects the west 10' of lot 7 and all of lots 8 and 9 and all of the vacated alley adjoining lot 9 in block 7 - Wifleburg Hills Addition. These two proposals - the proposal to re-zone and the proposal to establish a new building line - are related and, therefore, may properly be considered simultaneously. Reference is made to the applicant's letter dated March 8, 1956 which des- cribes his proposed plan in detail and the proposed site plan filed March 27, 1956. Briefly, the applicant has assembled approximately the westerly half of the block bounded by Rice on the west, Hawthorne on the north, Park on the east and Maryland on the south. He owns the entire frontage along Rice and his Hawthorne street frontage extends easterly a distance of 265'. The Maryland street frontage extends a distance of 280' from Rice. The lots under consideration for re-zoning and also involved in the building line change are those immediately to the east of the property which fronts on Rice street, The westerly most lot is approximately 146' easterly from Rice and the three lots extend east from this point a distance of 120' . The applicants propose to construct a south-facing building on the north half of their site. In order to do this it is necessary to change the building line along Hawthorne avenue to permit the building to be located far enough back from Maryland to provide adequate space for off-street parking. The buildings under consideration involve a super market on the lots to be con- sidered for re-zoning and to the west toward Rice will be a new drug stare and off-sale liquor store and a tavern. In order to consumate this plan it will be necessary to take final action on a pending petition to vacate the north-south portion of the "T" alley in this block and re-locate the southerly arm of this alley adjacent to the east line of the site so that the alley will actually be an "L" shaped alley which will connect to Maryland avenue. PUBLISHED • Re: Steiner -2- The applicants are proposing to establish a service drive onto Hawthorne avenue which will be closed by a chain-guard so that it will be available only for service access to the super market and will not be used for customer-approach to the facility. If this is done, it is felt that un- wanted traffic on Hawthorne avenue will be kept to a minimum. The nearest property to the east on Hawthorne which will be affected by this residential building line will be separated from the super market building by a 22' driveway. The applicants are making provision for a screen-planting or necessary fencing to exclude any undesirable view that might obtain as a result of this relationship. In this connection it might be said that of the twenty-five descriptions of property within 100' of the area sought to be re-classified, the owners of twenty-two have signified their acquiescence to this re-zoning petition. In consideration of the general desirability of undertaking the physical rehabilitation of this shopping area, the Zoning Board finds that the appli- cant's petition to re-classify the land from "C" residence to "Commercial" and to establish a new building line on the property under consideration as being 2' back from Hawthorne, is a reasonable one and which, if granted, will result in a substantial improvement to this community. In making this recommendation to grant these two requests, the Zoning Board takes note of the fact that the Use Permit for the parking lot involved will be considered by the Council at a later date when the re-zoning and building line questions have been resolved. The Zoning Board has reviewed the entire plan and is ready to make a favorable recommendation on the parking lot question as well. In consideration of these factors, the Zoning Board recommends the petition to re-zone the property under consideration and the petition to establish a new building line on the lots under consideration be granted.
