W / 1 PRESENTED BY �` ORDINANCE NO. . / 0741 An Ordinance making •rovision therefor and granting unto Farmers Union Grain Terminal Association, a Minnesota corporation, permission to construct, erect, maintain, and operate an overhead bridge containing _ and supporting a 36 inch belt conveyor for carriage of grain, over and across Shepard Road, from the top floor of the existing Municipal Grain Terminal Elevator Building to the Head House of the existing Farmers Union Grain Terminal Association Elevator Building) on a con- tinuous line approximately 475 feet westerly from the west line of Chestnut Street within the corporate limits of the City of Saint Paul, the center line of such overhead bridge to commence at a point approximately 3 feet 9 inches easterly of the northwest corner of said existing Municipal Grain Terminal Elevator Building and to extend on a straight line course northwesterly to a point approximately 2 feet 6 inches westerly of the southwest corner of the Workhouse of said Farmers Union Grain Terminal Association Elevator Building. This ordinance is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That permission and authority hereby are granted to the Farmers Union Grain Terminal Association to construct, erect, maintain, and operate an overhead bridge, containing and supporting a 36 inch belt conveyor for the carriage of grain, over and across Shepard Road on a line approximately 475 feet westerly from the west line of Chestnut Street, public streets within the corporate limits of the City of Saint Paul, said overhead bridge to represent a width of 11 feet and a height of 10 feet 6 inches, and the center line thereof to begin at a point 3 feet 9 inches easterly of the northeast corner of the existing Municipal Grain Terminal Elevator Building, and to extend therefrom on a continuous straight line course northwesterly to a point 2 feet 6 inches westerly of the southwest corner of the Workhouse of the existing Farmers Union Grain Terminal Association Elevator Building and to be constructed, maintained, and operated for the aforesaid purposes at an elevation so that the clearance line of the same shall be approximately 1I_ feet above the surface of said Shepard Road at and adjacent to said Municipal Grain Terminal Elevator Building, with a slope downward 1 foot vertical to 6 feet horizontal to said Farmers Union Grain Terminal Association Elevator Building, with a minimum clearance of approximately 95 feet above the surface of said Shepard Road and with a span of 68-1/2 feet. Section 2. Mr.President (Dillon) Approved: Attest: City Clerk Mayor 1000 12-54 008 177567 67 1- That said Permittee shall forthwith furnish and deliver unto the City of Saint Paul and the Port Authority of the City of Saint Paul a surety bond in the penal sum of $10,000.00, made and executed by said Permittee, as principal, and a corporate surety company duly authorized to transact business in the State of Minnesota, as surety, to and in favor of the City of Saint Paul and the Port Authority of the City of Saint Paul as obligees, conditioned that said Permittee, and its successors and assigns, shall indemnify and hold harmless said Oity of Saint Paul and said Port Authority of the City of Saint Paul, jointly and severally, against all expense and liability on account of all claims, suits and judgments arising out of or connected with the construction, erection, maintenance and/or operation by said Permittee and/or its successors and assigns of the aforementioned overhead bridge and appurtenances, which surety bond shall be in such form as shall be approved by the Corporation Counsel, and shall have such surety as shall be approved by the Commissioner of Finance. 2- That said Permittee, and/or its successors and assigns, shall, at its or their own cost and expense and in accordance with all applicable Ordinances of the City of Saint Paul, Statutes of the State of Minnesota, and regu- lations of public authority having cognizance, construct, erect, maintain, and operate said overhead bridge and appurtenances hereunder. 3. That said Permittee, and/or its successors and assigns, shall, at its or their own cost and expense, as aforesaid, construct and erect said overhead bridge and appurtenances under the supervision and subject to the inspection and approval of the Chief Engineer and. the City Architect, of said City of Saint Paul, and fully reimburse said City of Saint Paul, upon the receipt of proper invoices therefor, on account of all costs and expenses necessarily incurred by said City of Saint Paul for in- spection and engineering services, in the premises. 4- That said Permittee and/or its successors and assigns shall, prior to the commencement of the construc- tion and erection of said overhead bridge and appurtenances hereunder, at its or their own cost and expense and by a competent registered architect or engineer, cause to be prepared and submitted to said Chief Engineer and said City Architect of the City of Saint Paul, respectively, two complete sets of proper detailed plans and specifica- tions for said structure, which shall be subject to the approval of said Chief Engineer and that of said. City Architect. 5- That said Permittee, and its successors and assigns shall fully indemnify said City of Saint Paul and said Port Authority of the City of Saint Paul, jointly and severally, against all loss and liability on account of all damages, causes, suits and judgments and claims of • whatever nature for injury to person and/or property arising out of or connected with the construction, erection, maintenance and/or operation of said overhead bridge and appurtenances hereunder; and that supplemental to all other obligations on their part hereunder, said Permittee -2- • Original to City Clerk .. Attest: City Clerk _l- Mayor 1000 iz- s PUBLISHED X0767 and its successors and assigns shall, at its or their own cost and ensee, furnish and maintain, at all times, Casualty Insurance Coverage in a Casualty Insurance Company, duly authorized and licensed to transaet business in the State of Minnesota, in the amount of $300,000.00 for injury to any person and/or persons in any single accident and in the amount of $25,000.00 for injury to property in any single accident, indemnifying the City of Saint Paul and the Port Authority of the City of Saint Paul, jointly and severally, against liability on account of all claims of other persons for injury to person and/or property arising from or connected with the construction erection, maintenance, and/'or operation of said overhead bridge and appurtenances hereunder, and furnish competent evidence of said coverage to the Comptroller of the City of Saint Paul, from time to time, 6- That said Permittee and its successors and assigns shall,, among other things, at its or their own cost and expense, make adequate and effective provisions there- for and drain all moisture, rain and snow which shall accumulate thereon by proper devices through said over- head bridge and appurtenances and in a manner so that the flowing and/or spilling of the same on any part of said section of Shepard Road shall be prevented at all times. 7- That said Permittee and its successors and assigns shall construct and at all times maintain all , supports of said overhead bridge and appurtenances entirely within the lines of the said Elevator Buildings and entirely without public street areas. 8-- Thatmeither said Permittee nor any of its successors and assigns shall use any part of said over-- head bridge and appurtenances for any advertisement or display purposes and the application thereto of any adver- tising or display material shall be deemed prohibited by this ordinance. 9- That said Permittee and its successors and assigns shall, as aforesaid, at all pertinent times, in the construction, erection, maintenance and operation of said overhead bridge and appurtenances hereunder, provide a vertical clearance of at least 95 feet between and throughout the course of the bottom of said structure and the surface of said section of Shepard Road. l0 That said Permittee and/or its onccessors and assigns shall prosecute the work thereof diligently and. uninterruptedly and fully complete the construction and erection of said overhead bridge and appurtenances here. under and in accordance with the requirements hereof not later than the lst day of January, 1957. 11.
