Art}tniFWDu W#dti 17 t 'Wye An ordinance granting permission to Associated Contractors, Inc. to grade Tower Street from Wilson Avenue to Conway Street, and to construct a sewer in Tower Street from Wilson Avenue to Conway Street. This is an emergency ordinance rendered necessary for the preservation of the pblic peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That permission and authority are hereby given to Associated Contractors, Inc. to grade Tower Street from Wilson Avenue to Conway Street, and to consttuct a sewer, at its own expense, in Tower Street from Wilson Avenue to Conway Street. Section 2. The Commissioner of Public Works is hereby authorized to issue a permit to said Associated Contractors, Inc. for the grading of said street and the construction of said sewer, upon its compliance with the following conditions, viz: 1. Said permittee shall grade said street entirely at its own expense, and to. the satisfac- tion and under the supervision of the Commissioner of Public Works, and in accordance with plans and specifications approved by said Commissioner and the Chief Engineer of the City of Saint Paul. 2. Before entering upon or doing any of said work, said permittee shall procure from the abutting owners such easements in and to the abutting prop- erty as may be necessary for slopes, cuts and fills, and shall obtain a written release from such owners, releasing and discharging the City from any and all !Usages by reason of the grading of said street. 3. Said permittee shall construct said sewer entirely at its own expense, under the supervision and to the satisfaction of the Commissioner of Public Works, and in accordance with plans and specifications approved by said Commissioner and the Chief Engineer of the City of Saint Paul. 4. Said permittee, after the inception of said work, shall prosecute same continuously, with diligence, and fully complete said work, to the satisfaction and approval of the Chief Engineer, on or before October 1, 1956. 6. Said permittee shall pay the cost of engi- neering and inspection, and also for the publication of this ordinance. 7. Said permittee shall furnish a bond of $5,000.00 to the City of Saint Paul, conditioned to comply with all the terms of this ordinance, and to indemnify and save the City harmless from any and all loss, liability, judgments, suits, costs, charges, damage or expense that may accrue to person or property occasioned by the making of said improvem, ents or arising out of the same. 8. Said permittee sha ;L 1, within ten days after the passage and publication of this ordinance, file a written acceptance thereof with the City Clerk. Section 3. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safetye: Section 4. This ordinance shall take effect and be in force upon its passage, approval and publication.
