This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That upon compliance with the conditions hereinafter set out, the Commissioner of Public Works is authorized to issue a permit to The Golden Rule to construct an underground conduit, to carry electric current, between its parking ramp on the north side of Eighth Street and its main store on the south side of Eighth Street, at a point approximately 187.5 feet westerly throughout its course, of the west line of Robert Street. The conditions are as follows: 1. Permittee shall furnish a bond of $10,000 to the City of Saint Paul, conditioned to save said City harmless from any and all liability, judgments, suits,costs, charges, damage or expense accruing to person or property, arising out of the con- struction, maintenance, use, presence, or removal of said conduit. SAid bond shall be satisfactory to the Commissioner of Finance as to surety, to the Corporation Counsel as to form and execution, and shall be filed with the City Comptroller. 2. Permittee shall file plans and specifications for said conduit with the Commissioner of Public Works, which shall be approved by said Commissioner, and said conduit shall be constructed under the supervision and subject to the direction of said Commissioner. Permittee shall fully reimburse the City of Saint Paul for all costs and expenses of said City on account of such supervision and direction of said Commissioner. 3. Stid permittee shall commence work of the con- struction of said conduit and all installations therein on or before March 1, 1956, and there- after prosecute the same diligently and contin- uously, and complete the same not later than July 1, 1956. 4. At all times during construction, at least one- half of Eighth Street shall be kept open for traffic. This permit may be revoked by the Council at any time, and thereupon permittee shall remove said conduit. 7. Permittee shall, within ten days after the pub- lication of this ordinance, file a written acceptance thereof with the City Clerk. Section 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of thpublic peace, health and safety. Section 3. This ordinance shall take effect and be in force upon its passage, approval and publication.
