8. Resolution – 07-971 – Authorizing the Division of Parks and Recreation, and the proper
City officials, to accept the required funds and install a sign commemorating James T.
Sackett Park.
Councilmember Bostrom stated that Officer James T. Sackett was a fine, young man who
lost his life 37 years ago in the line of duty at too early of an age. He thanked the
Department of Parks and Recreation and the Police Federation for contributing to the
sign. He also thanked County Attorney Susan Gaertner for her work in brining two
convictions to the case. Bostrom stated that the installation of the sign is a means to
recognize and thank Officer Sackett for his service to the City of Saint Paul.
Councilmember Bostrom moved approval.

20. Resolution – 07-983 – Establishing a 2007 financing and spending plan in the Police
Department to provide funding for cameras and surveillance equipment along the Central
Corridor in Saint Paul.
Councilmember Helgen stated that this grant would lay the background and infrastructure
for wi-fi and future projects.
Councilmember Thune discussed the use of a similar camera system being used in Wales
in domestic abuse police calls. He asked the Police Department to get him information as
to how the camera system could be used in Saint Paul like the program in Wales.
Councilmember Montgomery thanked the business community, specifically Target Corp.,
for contributing a match to the grant.

39. Resolution – 07-930 – Authorizing CBS Outdoor to install new advertising bus shelters at

Fred Keuppers appeared on behalf of his client who owns the property at Snelling and
Portland Ave. and stated that he would hold his comments until the next public hearing as
there was intent to continue on November 7.
Councilmember Helgen asked Public Works to look into installation of a bus bench at
Arlington and Rice.
Councilmember Montgomery stated that Public Works was also looking into installing
bus benches at Valley Hi-Rise and Ravoux.

40. Resolution – 07-993 – Approving the petition of Shaw Lumber to vacate unimproved
Marion Street north of Como Avenue within the Shaw Lumber site in order to clean up
property title work prior to registration.

41. Resolution – 07-994 – Adopting the Central Corridor Development Strategy as a Chapter
of the City’s Comprehensive Plan.
Donna Drummond, Department of Planning and Economic Development, gave a staff
report including a brief history of the development strategy, the issues surrounding
parking near the Central Corridor, discussion on the Union Depot and the use of public
art in the construction.
A representative from Minnesota Public Radio and two pastors from surrounding
churches raised concern over the vibration that LRT would produce and it impact on their
structures.
Paula Maccabee, consultant for R.K. Midway, recommended changing the language such
that the Central Corridor Development Strategy would not be recognized as a hard and
fast plan but rather an illustration in context of the overall vision.
Veronica Burt of Equal Justice recommended that the number 16 bus route be maintained
as is, that a program be brought forth to restore the economic engine of the historic Rondo
neighborhood and to encourage additional stops at Western and Victoria Avenues.
Frances Goodlow stated that work needed to be done to ensure that senior citizens and
those on fixed incomes were not taxed out of their homes as a result of rising property
taxes.
Lisa Tabor stated that the City become committed to ensuring the vitality of the African
American Heritage Corridor as well as the Pan-Asian investments near LRT, such that the
Central Corridor Development Strategy was as inclusive and supportive of current and
future minority investments.
Art Weddington, of the Selby Area Community Development Corporation (SACDC),
agreed with Veronica Burt’s comments as they are consistent with both District 8 and
SADC’s future plans.
Reggie Alagada and Christina Smitten, both involved in the community process to create
the Central Corridor Development Strategy, stated that the outcome was very community-
oriented.

42. Resolution Ratifying Assessment - 07-995 – In the matter of the assessment of benefits,
cost, and expenses for repair of sanitary sewer connections from January to June, 2007.

Josh Buzicky, owner of 1306 Fremont, appeared. He questioned whether or not the City
had some responsibility to pay for the cost of the repair as it had allowed a house to be
constructed over his sewer line that connected out to Johnson Parkway in 1931. He also
questioned why the City did not correct the problem in 1938 when a sewer main was
constructed on Fremont Avenue.
Council President Lantry suggested laying the matter over for a week so that her office
could contact Public Works and provide Mr. Buzicky with answers.
Councilmember Thune moved to close the public hearing and lay over to October 24.

43. Public hearing to consider the appeal of Judith Beck and 31 neighbors to a decision of the
Board of Zoning Appeals approving the variances for lot coverage and setbacks to
redevelop the St. Paul Church Home site for senior housing with underground parking
and townhomes at 484 Ashland Ave. (This is a revised hearing notice which reflects
proposed changes to the variances requested as a result of discussions between the
appellants and the developer.) [ZF 07-137535] (Public hearing continued from October 3)
John Hardwick gave a staff report on the history of the appeal. In early summer, Real
Estate Equities went before the Board of Zoning Appeals to request variances. After a
two week lay over and two motions that failed, the variances were passed on a 5-2 vote.
The neighbors filed an appeal and began discussions in September with Real Estate
Equities to reach a compromise or a revised plan.
Judith Beck appeared on behalf of the neighbors and requested that approval of the
variances be delayed until after the HPC is given time to review the current plan. If not,
she requested that the variances be denied. She stated that although improvements have
been made as a result of the working relationship established with Real Estate Equities,
the neighbors remained at an impasse over the mass and size of the project.
Keith Jans, of Real Estate Equities, presented a powerpoint presentation of the history of
the requested variances and their work with the neighbors to accommodate the requested
changes.
Gar Harges, a neighbor of the project, spoke in favor of the project as a good opportunity
to provide a historically aesthetic opportunity for much needed housing in the
neighborhood.

Councilmember Montgomery moved to close the public hearing.
John Hardwick clarified that HPC approval is required before building permits are issued
and that the final design can change to fit HPC approval within the approved variances.
Councilmember Montgomery thanked everyone involved for their participation in the
dialogue between the neighbors and Real Estate Equities. As a result of the changes made
to the BZA-approved variances, Councilmember Montgomery moved to deny the appeal
and approve the modified variances.

44. Public hearing to consider the application of James McCann for a Combined Plat for
Update Addition to create five (5) industrial parcels and variance of parkland dedication
requirement at 2340 Capp Road and 2325 Endicott Street, southwest corner at Hersey
Street. (ZF 07-087-802)
Patricia James gave a staff report recommending approval of the platting by City staff and
District 12. The ordinance, as written, requires the parkland dedication fee to be based on
the entire area of the plat as opposed to the 3 parcels as requested. To keep cost
proportionate, an additional parkland dedication will be added at the time of construction
on the new parcels. Denial of the variance of parkland dedication fee was recommended
as it would set an unfamiliar precedent, nor would it cause an unnecessary hardship.
Jack McCann, representing himself and his brother Jim McCann, stated that they agreed
that they were not facing an undue hardship. Yet, they had been told by City staff to
replatt as opposed to a simple lot split and now felt they had been roped into a more
arduous and expensive process that what they had originally planned for.
Councilmember Benanav was excused from the meeting at this time.

Legislative Hearing Officer, Marcia Moremond, stated that the owner was a no-show at
the Legislative Hearing and she is unaware of any plans for rehabilitation.

46. Resolution – 07-997 – Ordering the owner to remove the building at 182 Front Avenue

Legislative Hearing Officer, Marcia Moremond, stated that all conditions had been met
except for the performance bond being posted.
Christina Weber appeared as counsel, on behalf of Fannie Mae and stated that Fannie had
a purchase agreement with Pemiko Properties. Pemiko Properties is hesitant to post the
bond without actually owning the property. Christina requested that the building not be
removed until negotiations were complete with Pemiko, at which time they would post
the bond.
Councilmember Helgen moved to close the public hearing and approval.

Legislative Hearing Officer, Marcia Moremond, stated that she had heard from Christina
Weber, on behalf of Green Point (the owner), that they were not interested in
rehabilitation. Christina Weber clarified that Green Point is not the owner of the property,
but the mortgage holder.

hearing and amend the timeframe from 15 days to 5.

Legislative Hearing Officer, Marcia Moremond, stated that only two of the necessary
conditions had been met and that the lack of proof of funds, the bond not posted, as well

as unpaid vacant building fees made the plan unacceptable.
The owner appeared in opposition and stated that the vacant property fees had been paid
and that the bond had been applied for, but not granted. He stated he has the financial
capability to improve the property and bring it to its full potential.
The project manager for the manager spoke to testify to his financial capability to finish
the project.
