An ordinance amending Ordinance No. 5840, entitled:
"An ordinance for the purpose of promoting the
public health, safety, order, convenience,
prosperity and general welfare by providing
for the classification, regulation and re-
striction of the location of trades and
industries, And of buildings used for human
habitation and for specified purposes, and
the height and bulk of buildings hereafter
erected or altered; and regulating and deter-
mining the minimum size of lot line courts and
other open spaces, and establishing the
boundaries of districts for said purposes"
approved July 7, 1922, as amended. This is an emergency
ordinance rendered necessary for the preservation of the
public peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That Ordinance Noe 584u, approved July 7,
1922, as amended, be and the same is hereby further
amended so as to rezone Lots 1 through 14, Block 14, and
Lots 15 through 28, Block 15, Summit Park Addition, from
"B" Residence District to "AW;Resideoce District.
0 Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
Section 3. This ordinance shall take effect and be in

Dear Sir:
This is in the matter of the application of Walter Mayo to rezone from "B"
residence to "A" residence, lots 1 through 14 - block 14- and lots 15 through
28 - block 15 - Summit Park Addition. This property includes the land front-
ing on the north and south sides of Fairmount between Victoria and Avon.
The owners of 82% of the several descriptions located within 100' of the
area sought to be re-classified have consented to this petition. Approximately
63% of the frontage involved within the area sought to be re-classified is also
represented on the petition. The property is presently developed predominantly
for one and two-family residences. There are four vacant lots within the area.
The attached display illustrates the present use of the property in the area
in relationship to those owners whose names appear on the petition.
In reviewing this proposal, the Zoning Board takes note of the fact that the
property to the north and east have been rezoned from "B" residence to "A"
residence subsequent to the enactment of the Zoning Ordinance. It appears
to be the intent of the owners of the property in this area to prevent future
conversions to multi-family housing which would increase the population density
of this area.
In view of the expressed desire of the majority of the owners of property in
this area to retain the existing high standards of this neighborhood, the
Zoning Board feels that the effect of this proposed re-classification would be
in the direction of securing this objective.
In view of the existing one-family and two-family character of this neighbor-
hood, the Zoning Board finds that the proposed residence classification would,
in fact, reflect the highest and best use of the property within the district.
In consideration of these factors, the Zoning Board recommends that this
petition be granted.
