THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That Ordinance No. 5840, approved July 7, 1922,
aeameaded be and the same is hereby further amended so as to rezone
Lots 1, 2, 3 and 4, Block 79, Dayton and Irviness Addition, from
"C" Residence District to Commercial District.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of the
- public peace, health and safety.
Section 3. This ordinance shall take effect and be in
force upon its passage, approval and publication.

Dear Sir:
This is in the matter of the petition of the David C. Shepard Estate to
re-zone from "C" residence to "Commercial" lots 1, 2, 3 and 4 - block
79 - Dayton & Irvine's Addition. This property is located adjacent to
the south side of D yton between Virginia and Dayton.
The property under consideration has a frontage of 284' on Dayton and
extends southerly a distance of 116.5' on Farrington and Virginia. It
has an area of 32,986 sq. ft. It is directly north of the existing
commercial zoning which fronts on Sell* Avenue in this vicinity.
The applicants propose to use this property for the administrative office
of an insurance agency as outlined in the applicant's letter dated October
31, 1956. The Zoning Board finds there is adequate space on the premises
for off-street parking and that there will be no external modification of
the premises except for a small sign identifying the nature of the activity
within.
Adjacent land uses are as follows: there is a rest home and catering ser-
vice across Dayton to the north: there is a mixture of commercial and
residential uses to the south along Selby Avenue, there is a vacant lot
across Virginia to the west and .there are apartments fronting on Farrington
to the east. The property is presently occupied by a large residential
structure which would be converted for office use. The company presently
employs four full time employees and four part time employees.
The zoning Board finds that if the applicant's plans are carried out, the
activity contemplated is a logical means of using this old structure that
is on the premises. The alternative use for this building would be for
apartments.
In consideration of these factors, the Zoning Board recommends that this
petition to re-classify the property under consideration for the purposes
specified in the applicant's letter dated October 31, 1956 e granted.

Gentlemen:
Arrow Insurance Co. of St. Paul has entered into an earnest money
contract with the Estate of David C. Shepard for the purchase of
the following described property:
Lots 1, 2, 3, 4, 8, and 5 except the South 100 feet
thereof, and 7 except the West 4 feet thereof, Block
79, Dayton & Irvine's Addition to St. Paul, Ramsey
County, Minnesota.
It is the company's intention to use the building located thereon,
known as 324 Dayton Avenue, as the Home Office of the company.
The entire south half of Block 79 (which includes Lots 5, 6, 7
and 8) is now zoned "Commercial".
If the property is not rezoned from a Class "C" Residence District
to Commercial District the company can not so use the building and
the earnest money contract provides that each of the parties will
be released and the earnest money refunded.
The Arrow Insurance Co. is an automobile liability insurance com-
pany with its home office in St. Paul, Minnesota, and employs at
present 11 full-time employees and 4 part-time employees. Most
of the business written by the company is written by varioms insur-
ance agencies throughout the state of Minnesota who forward the

age of the company's business is written directly with the public.
A few agents come directly to the company's office to transact
their business. The operation at 324 Dayton Avenue would be
essentially the administration of the business and not a sales.ityps
operation. The company operates its business during usual business
hours.

It is estimated that the garage presently on the premises, to-
gether with the existing driveways will accommodate at least
eight automobiles for off-street parking. In the event the need
for off-street parking should be greater,. Lot 8 and Lets 3 and 4
and the north 16i feet of Lot 5 can be utilized for parking.
This area exceeds any parking space needs foreseeable.
The company has node a tentative agreement with Mr. John Bahnaman,
present caretaker of the buildings and grounds for the Shepard
family, to care for the grounds and buildings as he has in the
past. It is the company's intention that this property shah.
remain a credit to the neighborhood.
The company does not contemplate any alterations to the buildings,
except perhaps the installation of fluorescent lighting, as
required, and does not contemplate any new construction or out-
side alteration of the buildings. If the company acquires this
property it intends to retain possession of all of the property
and has no plans to dispose of any portion of it.
With regard to advertising, it is proposed to erect dignified
identification of the site as the location of the home office of
Arrow Insurance Co. and its general agent. As indicated, th,
property would not be essentially a sales office.
