Rock to reclassify from Light Industry and "C" Res. to "A" Res. property located adjacent to the northeast corner of Miss. River Blvd. and Highland Pkwy. This property is described as Lots 6,7,8,9 & 10, Block 2 , Edgcliff Add. No. 2. It has a frontage of 240.65 ft. on Miss. River Blvd., 256.7 ft. along Highland Pkwy. in an east-west dimension and has a dimension of 228 ft. along its easterly boundary. The southerly 121.5 ft. of this property is presently occupied by the Church of Christ Scientist. The remaining 107 ft. to the north is vacant and is presently-contemplated for development as a 19 unit apartment site. The zoning history of the property under consideration goes back to 1922 when it was placed in an "A" Res. classification at the time St. Paul adopted its original zoning ordinance. In 1923 the southerly 121.5 ft. of the tract under consideration was zoned Light Ind. as part of the comprehensive rezoning of the Ford Motor Co. district which occured at that time. In 1939 under two separate actions the easterly or rear 100 ft. of the Church of Christ Scientist proper,��,,t�yqq p us the land presently proposed for an apart- ment house site was rezoned from Lighta`�Inc�'., cf "C" Res. The remainder of the church property was retained in a Light Ind. classification and is presently so zoned. This petition presently before the Council would place both tracts in an IIA" Res. zone. The adjacent land uses are as follows: Miss. River Blvd. is to the west, there are single family homes to the north and to the east. There are apartments across Highland Pkwy. to the south adjacent to the southwest and southeast corners of Highland a Ploodlawn. The property adjacent to the southeast corner o: Miss. River Blvd. and Highland Pkwy. is vacant and zoned "C" Res. The Zoning Board, after having the benefit of the testimony of the interested parties involved on both sides of this issue, is unable to find that the present zoning classi- faction of "C" Res. is improper from the standpoint of the most' suitable use of the land and the interest and equities of all parties affected. In this connection is should be noted that Light Ind. is not the best classification for the portion of the church property so zoned, and desirably should be corrected in a separate action. In making this recom- mendation it takes note of the existance of the church immediately to the south with its attendant parking and traffic, and other apartment developments in the immediate vicinity. It is also mindful of the general desirability of making provision for a variety of dwelling unit types to meet the range of requirements for housing which occur in every neighborhood. In spite of this, the Zoning Board does feel that the nature of the property under consideration is such that it lends itself to develop- ment of an apartment site in a manri-r compatible with the interest of adjacent property owners and all applicable city regulations. We have pioneered the beautification of our area. We have invested our savings in building beautiful homes in our section, Woodlawn and River Road at Highland Parkway. After we have spent years developing this prop- erty, Herman Paster informed us that he intended to build a large apartment building on the adjacent property. Did he do this before we built our homes? Not He waited until we had improved the area. We have gone to the City Council, and after a fair hearing the Council voted in our favor, 6 - 1, to keep out an apartment building. But did this stop the business interests that own the property? No, again! Through stalls and legal maneuvers which the Ramsey County Court itself termed "premature", they have prevented a final approval of this ordinance for about a year. Now we are told that a "re-hearing" is scheduled for October 22. How long must a group of citizens fight big money to maintain its fundamental constitutional rights granted all of us - to build and own our own home in the surroundings of our own choice? We as small home owners don't have the funds to match those at the command of these other interests. If this is permitted, no citizen in Highland Park can be assured that his home is safe from undesirable encroachment of buildings not in har- mony with the fine neighborhood he and his neighbors have developed. Should the City Council and we citizens be continually harassed with this kind of activity? I ask you to particularly observe the memorandum the Judge has written in connection with this matter . I would greatly appreciate it if before the last hearing a motion could be made to set this matter over to a definite date in the future and to notify all parties concerned for an opportunity to be heard before final action is taken in the passage of this matter . This would give us an opportunity to present our revised plans for the proposed apartment building, which would reduce the number of apartments from twenty-two to fifteen and eliminate the use of the alley entirely. In addition, there would be no con- gestion as far as parking, and I believe all the other objections that were previously raised could be overcome. I am also in a position to show to the council that many of the objectors who signed the petition that was circulated live in Minneapolis , Roseville, West St . Paul and South St . Paul , and were not even residents of the City of St . Paul , and in one particular case two people whose names appear have signed affidavits that it is not their signatures on the petition and that they were placed thereon without their authority, permission or consent . We have gone to the City Council, and after a fair hearing the Council voted in our favor, 6 - 1, to keep out an apartment building. But did this stop the business interests that own the property? No, again! Through stalls and legal maneuvers which the Ramsey County Court itself termed "premature", they have prevented a final approval of this ordinance for about a year. Now we are told that a "re-hearing" is scheduled for October 22. How long must a group of citizens fight big money to maintain its fundamental constitutional rights granted all of us - to build and own our own home in the surroundings of our own choice? Ale as small home owners don't have the funds to match those at the command of these other interests. If this is permitted, no citizen in Highland Park can be assured that his home is safe from undesirable encroachment of buildings not in har- mony with the fine neighborhood he and his neighbors have developed.
