This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Ordinance No. 5840, approved July 7, 1922, as amended, be and the same is hereby further amended so as to rezone the following described property _from "Cil Residence District to Commercial District: Lots 10 and 12, Auditorts subdivision No. 67, located near the northwest corner of Capitol Heights and University Avenue. Section 2. This ordinance is hereby declared to be an emerge-ney ordinance rendered necessary for the preservation of the public peace, health and safety. Section 3. This ordinance shall take effect and be in force upon its passage, app roval and p ublication. NINNSfOTA November 26, 1957 Mr. Joseph Okoneski City Clerk Building Dear Sir: This is in the matter of the petition of Wilbur Both to rezone from "C" Res. to Commercial two lots near the northwest corner of Capitol Heights and University. This property is described as Lots 10 is 12, Auditor's Subdivision No. 67. The property under consideration has a frontage of 46 ft. on Capitol Heights and 57.9 ft. on Univ, and extends between these two streets. It is presently vacant property. The City Council on June of 1957 rezoned one lot adjacent on the east and south for construction of a restaurant. Applicant has since ac- quired the two lots which are under consideration and wishes to pro- vide additional off-street parking facilities in connection with this restaurant. The adjacent land uses are a mixture of commercial and residential an character. However, the area is characterized by a pronounced shift from residential to commercial activities as is evidenced by the Pitney - Bowes establishment just to the west on the north side of Univ. and the proposed IBM building on the south side of Univ. on the old St. Paul Hospital site. The Zoning Board finds therefore, that the pro- posed zoning pattern is a proper one from the standpoint of the highest and best development of the district and that the applicant's plans reflect a high standard of development within the framework of the proposed zoning pattern. In consideration of these factors the Zoning Board recommends that this petition be granted.
