Does Ordain:
SECTION 1
An ordinance amending the Zoiiing Code,

is an emergency ordinance rendered

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64 inclusive of
the Saint Paul Legislative Code, as amended, pertaining to Use
Districts, Height Districts and Rezoning of certain properties in
the City of Saint Paul, be and the same is hereby further amended
so as to rezone the following described property from Cass "B"
Residence District to Class "C" Residence District:

PAUL, GREETINGS:'
The undersigned petitioner respectfully submits this
matter for your.consideration with the hope that it will meet,
your approval and sanction.
The real estate described is more commonly known as
the south side of Baker Street. lying between Woodbury and Brown
Avenues, and consists of eight lots measuring 40 feet in width
and 123 feet in depth. Collectively, these -lots were the site
of the former Hendricks School,- 'which was constructed in the
year 1886 and was used last for classes during the school -year
Of 1953 to 1954. The building -was razed in December of the year
1954.
After clearing the property of the school,building, the
School Board of the City-of'3aint.Pau1 placed this property up
for 'bid, which I later purchased with the thought of building
apartment units upon -it 1_-
Cognizant of the fact that rezoning would be necessary,,
I canvassed the adjoining property.owners to unite in my petition
to rezone. Out of 24 possible signees,,I was able to contact 21.
Out of the 21 contacted, 20'joined into the petition. In summary,
the petition signees represent 83.33% of the adjoining and surround-
ing property owners. In order that you may obtain a more concise
picture of the area, your attention is- invited,to the small attached
plat marked "Exhibit All.,. The-blue dots represent residents who
signed the petition.
The building program -which I proposed to follow was to
construct three 11 -unit apartment buildings, complete with off -the-
street parking, at a cost of #3001 000.00. Attached and marked
"Exhibit B11 is an architect's'" sketch of one of the three proposed
apartment buildings. ry °
Your attention is also invited to the attached Site
Development Plan which is marked °Exhbit C". This plan gives a
complete outline of land utilization.

Recently, the Saint Paul_ -City Planning Board voted, by a
margin of three to two, against my; rezoning petition, primarily
on the grounds that the area concerned with this petition should
'be conserved for single and double -unit dwellings only.
For those, of you who are- not, 'familiar with this section
of the`city, may I point out that this area is one of the oldest
districts ,of the City of- Saint Paul'.- Further, that the majority
of residences consists of very old but well -cared for - homes.
There is also an intermix of duplexes and single -unit homes through-
out, with one large five family -unit adjacent thereto.
In view of the trend toward rambler and ranch -style single -
unit homes, this land could not be fully utilized because of the
width of each lot, taking into consideration that a three bedroom
t rambler (non" expansion type) requires a foundation of approximately
40 feet in-length.- It would follow that a rambler duplex would
occupy a much longer foundation area.
East Baker Avenue -is a dead nd street at its most eastern
point, and Brown Avenue, not being cu through and completed, fronts
the dead end of Baker-Avenue and the ead end of the alley now ex-
isting, thereby making a very undesir ble location for single and/or
double -unit construction'.
This property has been real state tax- exempt since 1996,
and'with a development such as the on�le outlined in the attached
plans, would greatly increase(-,the assessed- valuation.of this here-
tofore untaxed property. Adjoining property owners would also
benefit by this program in that the value of their property would.

This is in the matter of the petition of Ralph Traficante to rezone from "B"
residence to "C" residence vacant property located on the southwest corner of
Baker Street and Brown Avenue. 'The property is described as Lots 1 thru 8
inclusive, West Side Land and Cottage Co.'s Subdivision of Block 36, Brown &
Jacksons Addition to West St. Paul. The zoning_ is "B" residence and has been
since the adoption of the Ordinance in 1922.
The Commissioner of Finance in a letter to the City Council dated October 2,
1959, reported the petition to be sufficient and that the owners of 20 of a
possible 24 tracts of land within the prescribed 100 foot radius (83.33 %) bad
signed the petition. ,
The property under consideration was sold to the petitioner by the City of St.
Paul on April 6, 1959. It was the former site of the Hendricks'School. The
applicant proposes to construct three eleven -unit apartment buildings with 33
off - street parking spaces accessory - thereto as indicated on the attached plot
plan. The proposed development meets the recommended standards for density
and building ground coverage. The site-has a frontage of 317 feet along Baker
Street and a depth of 123 feet, resulting in an area'of 38,991 square feet,
or .9 of an acre. Directly west and adjoining are three residences which front
on Baker Street, two are single - family and one is a two - family residence; south
and - across an unimproved alley are�five single - family residences which front
on Morton Street, two of which were rather.recently11 constructed, also four lots
which are undeveloped with two of tLem being used as yards to existing'residences;
north and acwss Baker Street is vacant land which is unbuildable because of its
steepness in grade; east and across unimproved Brown Avenue (which is approxi-
mately 25 feet below the grade of the property under consideration) is a single -
family residence.

The petitioner's property with relationship to the adjoining streets is as
follows: Baker Street adjoining on the north is approximately 12 feet below
the petitioner's property at the easterly end, and 8 feet below at the westerly
end. Brown Avenue is approximately 25 feet below the petitioner's property.
The property itself is level and at grade with the alley adjoining on the south.
Baker Street which adjoins this property on the north is graded, but has a steep
easterly grade and dead ends at the east end of the petitioner's property. Brown
Avenue is ungraded and appears to be a natural drainage draw.
Field investigation discloses that this area is developed with single and'two-
family residential uses. The general neighborhood consists of older homes with
some scattered new residences. Two of the homes adjoining the property under
consideration are rather new. To the north and east of this property is a steep
bluff line which separates this property and the surrounding neighborhood from

the lower level on Concord Street. It is felt that this area should remain
as a single and two - family residential neighborhood and that multi - residential
use would not be compatible to the existing uses. The proposed land use guide
plan indicates that this area should remain as one and two- family residential
use and that any proposed multi - residential use should be at the level below
the bluff line.
Inconsideration of the above factors, the Board of Zoning recommends the
denial of this petition to rezone the above property from "B" residence to
"C" residence.
