Peterson —M1!•- ton Rosr,iaASi7F, yYnR+ An ordinance establishing, prescribing, and, mulgating rules and regulations therefor•.and authorizing and providing for severance pay measured by but not based upon accumulated and unused sick leave credits to become payable and to be paid by the City of Saint Paul to its employees in its Classified Civil Service and to its employees in its unclassified exempt service, except its elected officials; and amending Ordinance No. 3250-2, of said City, entitled: "Ari administrative ordinance relating to the Civil Service Bureau of the City of Saint Paul, approving and adopting rules and regulations therefor," approved August 20, 1911., as amended., This is an emergency ordinance rendered necessary for the preservation of the public peace, health, .and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: \--a _. Section 1. That the City of Saint Paul, hereunder and subject and pursuant to the hereinafter prescribed and promulgated rules and regulations therefor, shall pay to arty employee in its Classified Civil Service or unclassified exempt service, other than an elected City official, -or to the estate of any such employee deceased, upon separation from the service by resignation, retirement, layoff,.expiration of leave of absence, or death, severance pay measured by but not based upon accumulated and unused sick leave credits. Section 2.. That any such employee, in the Classified Civil Service or unclassified exempt service, of said City, other than an elected City official, for the purposes of this ordinance and the computation and determination of accumulated and unused sick leave credits for the measure- ment of such severance pay, shall be deemed for the period of his employment to-have accumulated sick leave credits at the same rate and in the same amount as prescribed for accumulated sick leave credits, under and by virtue of applicable provisions of the Civil Service Rules and Regulations incor- porated in said City's Ordinance No. 32502, entitled: "An administrative ordinance relating to the Civil Service Bureau of the City of Saint Paul, \� approving and adopting -rules and regulations therefor,'' approved August 20, 1911., : as amended. That hereunder and for the purposes hereof, provision is made for UJ in the attachment to the several employments in the Classified Civil Service and \ :z to the several employments in the unclassified exempt service, throughout the -� periods of the same,Faccumulated sick leave credits at the same rate and in the same amount as that provided to attach to Classified Civil Service o employment under said Civil Service Rules, without discrimination. 1 oSection 3. That the administrative head of said Civil Service o- Bureau shall compute and determine and certify to the CityComptroller the o amount of the accumulated and unused sick leave credits of any such Classified Civil Service employee, upon his separation from the service, in any such case, and upon the bases of the aforesaid attached_ and hereby civdi.ted accumulat�ti.: sick \ leave credits :..,and: the used sick leave chargeable against and deductible from the sang as shown by the pertinent official public records compiled and maintained, as such, in said Civii Service Bureau. That the head of the department shall compute, determine, and certify to the City Comptroller the amount of the accumulated and unused sick leave credits of any such unclassified exempt employee, upon his separation from the service, in any such case, upon the bases of the aforesaid attached and hereby credited accumulated sick leave credits and the used sick leave credits chargeable against and deductible from the same as shown by the pertinent public records, if arty, compiled and maintained, as such, in the department. Section 5. That in the event of the incompleteness or inadequacy otherwise of any such public records for any 'such computation, determination, and certification of accumulated and unused sick leave credits by the administrative head of said Civil Service Bureau`or by the head of the department , such computation, determination, and certification shall be made upon the bases of the aforesaid attached and hereby credited accumulated sick leave credits and the used sick leave credits chargeable against and deductible from the same^as shown by such pertinent public records and such necessary additional competent and relevant evidence as shall be made available. Section 6. That in the event of the nonavailability of any such pertinent public records for any such computation, determination, and certification of accumulated and--unused sick leave credits by the administrative head of said Civil Service Bureau or by the head of the department, such computation, determination, and certification'._shallcbe made upon the bases of the aforesaid attached and hereby credited accumulated sick leave credits and the used sick leave credits charge - able against and deductible from the same as shown by such other necessary, competent and relevant evidence as shall be made available. Section 7. That in the event of the nonavailability of any such pertinent public records and that of any such other necessary competent and relevant evidence, in any such case, for the computation, determination and certification of accumulated and unused sick leave credits, hereby there shall be attached and credited to the subject Classified Civil Service or unclassified exempt service employee, other than an elected City official, for the measurement of such severance pay hereunder: 72 days of accumulated and unused sick -leave credits for each full year of continuous service after December 31, 19403 and 5 days of accumulated and unused sick leave credits for each full year of continuous service prior to January 1, 1941, such latter alloca- tion in no case to exceed 100 days ofacaumulated and unused sick leave credits; and in each such case the certifying officer shall accordingly compute, determine, and certify to the City Comptroller the amount of accumulated and unused sick leave credits and the nonavailability of any such pertinent public records and that of such other necessary competent and relevant evidence for said purposes. Section 8. That henceforth the head of each department of said City shall compile and maintain in his office public records accurately reflective of Classified Civil Service and unclassified exempt service employee absence from work therein, because of sickness, injury, or other cause set forth in Section 35)F3 of said Civil Service Rules and Regulations, other than those pertaining to any such elected official, and to make accurate and detailed written monthly reports thereon to the administrative head of said Civil Service Bureau. Section 9. That said Ordinance No. 32502, approved August 20, 1911,., as amended, hereby is further amended by inserting in and as the•second paragraph of Section 35 F3, the following: -2- �r�90 "Upon separation from the service by death or retirement, or after all reinstatement rights have expired following-resignation, layoff or leave of absence, which resignation, layoff or leave of absence occurred after the effective date of this ordinance, an employee or his estate shall be paid, as severance pay, an amount equivalent to one -half day's pay for each full day's accumulated and unused sick leave credit; provided (a) that at the time of separation the employee has not less than sixty days of sick leave credits; (b) that the rate of payment shall be the daily rate that the employee was receiving on the last day that he worked; except that if an employee is cus- tomarily employed under more than one title he shall be paid at the rate for the position under which he was employed the longest during the twelve months' period immediately prior to the date when he last worked. For the purposes of this section, the daily rate shall be twelve times the monthly rate divided by 261; (c) that no employee or his estate shall be paid severance pay for more than one hundred days (one -half of two hundred days' accumulated and unused sick leave credits) nor more_ than.. $3, 500;, however, -if the total severance pay for such one hundred days is less than $2,500, and the employee has additional accumulated and unused sick leave credits in excess of two hundred days, he or his estate shall be paid for such additional days credits , but such total severance pay shall not exceed $2,500. (d) If an employee has an accumulation of sick leave credits in excess of two hundregl days, he may con- vert any part of such excess to vacation at'the rate of one -half day's vacation for each day of sick leave credit. (e) The maximum number of days vacation allowed by the conversion of sick leave credits shall be no more than five days in any one year, so that the maximum vacation time which may be taken in any one year shall be twenty days including the, regular vacation period." Section 10. That upon separation from the employment service of the City of Saint Paul, by death or retirement, or after all reinstate- ment rights have expired following resignation, layoff or leave of absence, and which separation shall have occurred after the effective date of this ordinance, any Classified Civil Service or unclassified exempt service employee, other than an elected City official, or his estate, if deceased, shall be paid, as severance pay, an amount equivalent to one -half day's pay for each full day's accumulated and unused sick leave creditrcomputed, determined,.and-cert�fied as hereinabove provided; provided (a) that at the time of his aforesaid'separation the -em- ployee has not less than sixty days of such accumulated and unused sick leave credits; t —3— W that the rate of payment shall be the daily rate that the employee was receiving and entitled to receive as and for wages or salary in his employ- ment on the last day'of his work; except that if an employee was customarily employed under-'more than one title he shall be paid at the rate of the wages or salary for the position under which he was employed the longest during the. twelve_ months? period immediately prior to the date when he last worked.
