Rein's petition to amend the Zoning Code by rezoniiig'from "A" Residence to "Commercial" certain property located at the northeast corner of Clarence and Magnolia. The legal description is: "Commencing at a point on the north line of the NW 1/4 of Sec. 27, T. 29, R. 22, 139.47 ft. west of the NE corner of the. NW 1/4 of the. NW 1/4 of said Sec. 27; thence south 0008' east 423 ft. to the point of beginning of the land to be described; thence south along the last described line 893.58 ft. to the south line of said NW1 /4 of the NW 1/4, thence west along said south line 488. 51 ft. to a point which is 33 ft. east of the west line of the E. 1/2 of the NW 1/4 of the NW 1/4 of said Sec. 27; thence north along a line 33 ft. east of the west line of the E. 1/2 of said NW 1/4 of the NW 1/4 782. 18 ft. to its intersection with the easterly line of Pros- perity Ave.; thence NE'ly along the easterly line of Prosperity Ave. 136 ft.; thence east parallel with the northerly line of said NW 1/4 411.89 ft. to the point of beginning, except the east 100 ft. thereof, according to the United States Government Survey thereof, all being in the County of Ramsey, State of Minnesota." The present zoning is "A" Residence. The Commissioner of Finance on February 11, 1959, reported this petition sufficient with 7176, or the owners of five of the seven properties located within a 100' radius having signed the petition. On October 18, 1958, the City Council re- classified the property directly adjoining on the north from "A" Residence to "Commercial" for the future development of the Phalen Shopping Center. The property under consideration is presently undeveloped. The south 33' of the property has been conveyed to the City of St. Paul for street pur- poses. The remaining portion of 67' is proposed by the applicant to be incorporated with the property which was re- classified by previous Council action for the purpose of developing the Phalen Shopping Center. At the time of the review of the Phalen Shopping Center by the Zoning Board, it was the understanding of the Board that the south 100' adjacent to Magnolia Avenue would remain as a buffer between the proposed Shopping Center and the residences to the south of Magnolia Avenue. The entire tract has a frontage of 488.5' along Magnolia and a depth of 100' resulting in an area of 48,850 sq. ft. However, because the southerly 33' have now been taken for street purposes, the remaining area amounts to approximately 32,730 sq. ft. This is the area which the applicant requests to have rezoned. r C aT � i C. G. Rein - continued -2- The adjacent land uses are: north adjoining - presently vacant, undeveloped land now zoned "commercial'; east and west adjoining - also vacant, un- developed land; south across Magnolia Ave. - mostly undeveloped and zoned "heavy industrial. " However, the southeasterly corner of Magnolia and Mechanic Ave. is developed with single- family residence which fronts on Mechanic Avenue. Mechanic Avenue is entirely developed with new single - family residences on both sides of the street. A review of the matter by the Zoning Board and its staff, and field investi- gation, discloses that the granting of this rezoning of the property under consideration would permit commercial development up to Magnolia Ave. It was the opinion of the Board that the re- classification of this property to "commercial" would be detrimental to the residential development to the southwest across Magnolia. The Board is of the opinion that this pro- perty should continue as "A" Residence which would serve as an effective buffer between the proposed Phalen Shopping Center and the residential area as previously pointed out. In consideration of the above factors, the Board of Zoning recommends that the petition to rezone the property under consideration from "A" Residence to "Commercial" be denied.
