An ordinance granting,permission to Edgecliffe
Investment Company to reconstruct, -at its own
expense, the existing public sewer within the
lines of an existing public sewer easement in
Lots 6 and"7,4nd the north 12.5 feet of Lot 8,
all in Block 2, Edgecliffe Addition No. 2, accord-
ing to the plat thereof on file and of record
in the office of the Register of Deeds, in and
for Ramsey County, Minnesota. This is an emer-
gency ordinance rendered necessary for the
preservation of the public peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority are hereby
t granted Edgecliffe Investment Company to reconstruct, at its own
expense, the existing public sewer within the lines of an existing
pubii.c. sewer easement in Lots 6 and 7, and the north 12.5 feet of
Lot 8," all in Block 2, Edgecliffe Addition No. 2, said existing
sewer easement being-_10 feet 'in width, the center line of said
easement being described as "follow: Beginning at a point on the
north line of Highland Parkway 124.0 feet east of the westerly line
of Lot 10, Block 2, Edgecliffe A ddition"No. 2, as measured along the
northerly line of Highland Parkway; thence northerly on a straight
line,to a point on the north line of Lot 6, Block 2, Edgecliffe
Addition No. 2 that is 119.0 feet east of the northwest corner of
said Lot 6. �-
Section 2. The Commissioner of Public Works is-hereby
authorized to issue a permit to said Edgecliffe Investment Company
for the reconstruction of said sewer, upon its compliance with
the following conditions, viz:
1. Said permittee shal ljconstruct said sewer
entirely at its own expense, under the supervision
and to the satisfaction of the Commissioner of
Public Works, and in accordance with plans and
specifications approved by the Chief-Engineer of
the City of Saint Paul.
2. Said permittee shall pay the cost of
engineering and inspection of said work, and
shall pay the cost of publication of this ordinance.
3. Said permittee shall properly protect
all excavations made, both day and night, -so as
avoid all damage or injury to person or property,
and shall properly fill and tamp the strip of
land embracing said easement, so as to avoid
settling.

4. Said permittee, after the inception of said
work, shall prosecute same continuously, with,
diligence, and fully complete said work to
the satisfaction and approval of the Chi Engineer
of said City.
5. Said permittee shall file a bond running
to the City of Saint Paul, in the sum of
$10,000, conditioned to comply with all the
terms of this ordinance, and to indemnify and
save harmless said City frm all liability,
charges, loss, judgments, suits, costs or expense
that may accrue to persons or property, occasioned
by the making of said improvement or arising out
of the same.
6. Said permittee shall, within ten days after
the passage and publication of this ordinance,
file a written acceptance thereof with the City
Clerk.
Section 3. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of
the public peace, health and safety.
Section 4. This ordinance shall take effect and be in
force upon its passage, approval and publication.
