An ordinance granting permission to Great Northern Railway Company, the fee owner of the involved real property, to construct and maintain in Bayless Avenue vacated, two catch basins with appurtenant pipe connections therefrom.to the existing six foot three inch public sewer therein, the point of con- nection being the existing manhole approximately 387 feet west of the center line of Re_ymopd Avenue and approximately 60 feet south of the south line of Tainter Avenue vacated, for the carriage and disposi- tion of storm or surface waters. This is an emergency ordinance rendered necessary for the pmservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That permission and authority are hereby granted to Great Northern Railway Company, the fee owner of the involved real property, to construct and maintain in Bayless Avenue vacated, two catch basins with ap urtenant pipe connections therefrom to the existing six foot three '1nch public sewer therein, the point of connection being the existing manhole approximately 387 feet west of the center line of Raymond Avenue and approximately 60 feet south of the south line of Tainter Avenue vacated, for the carriage and disposition of storm or surface waters: Section 2. That the Commissioner of Public Works hereby is authorized to issue a permit to said Great Northern Railway Company for the construction a,nd maintenance of said catch basins and appurtenant pipe connections therefrom to the said public sewer in Bayless Avenue vacated upon said permittee's compliance withthe following conditions: x 1. Said permittee shall construct said catch basins and said appurtenant pipe connections in accord- ance with all applicable•provisions of the Standard Plan on file in the office of, -the Department of Public Works of the City of Saint Paul, such pipe connections in no case to exceed 12 inches,in diameter, and otherwise in accordance with plans and specifications therefor to be furnished by said permit tee and approved by the Com- missioner of Public Works. ' 2. Said permittee shall prosecute the work of said installations of said catch basins and said pipe connections under the supervision and to the satisfaction of said Commissioner of Public Works, and shall pay to said City its incurred costs for engineering and inspection of said work, and for the publication of this ordinance. Said permittee'shall commence said work not later than October 1, 1959 and complete the same not later than March 1, 1960, and shall prosecute the same continuously and with diligence. 4. That said permittee in connection with its construction and maintenance of said catch basins and appurtenant pipe connections shall make due compliance with all applicable ordinances of the City of Saint Paul and statutes of the State of Minnesota, and shall fully indemnify and save harmless said City from and against all liability, costs and expense on account thereof and on accountfof any and all-injuries to person or property resultant therefrom. 5. That the locus in quo, the positions of said catch basins and manhole and the lines of said pipe 'connections as the same are proposed to be constructed and installed therein, are shown upon that certain map of the same;._ prepared by said permittee and filed here- with and hereby incorporated herein and made a part of this- ordinance by reference. 6. That said permit tee shall, within 10 days after the passage and publication of this ordinance, file its written acceptance thereof with the City Clerk. Section 3. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 4. This ordinance shall take effect and be in force upon its passage, approval and publication.
