An ordinance granting permission to Linwood
Baseball Assoeivbion, an unincorporated, nonprofit
association, for the temporary use of the following
described undeveloped City of Saint Paul real estate;
the East 300' of Block 15, Ridgewood Park Addition,
which is bounded on the west -by Chatsworth Street,
on the north by Jefferson Avenue, and on the-south
by Juliet Avenue, for a Little League Baseball Diamond.
This is an emergency ordinance rendered necessary for
the preservation of the public peace, health, and
safety.
THE COUNCIL OF THE CITY OF SAIM PAUL DOES ORDAIN:

Section 1. That permission and authority are hereby granted
to Linwood Baseball.Association, an unincorporated, nonprofit association,
temporarily to use the following described undeveloped City of Saint'Paul
real estate: the East 3001 of Block 15, Ridgewood Park Addition, which is
bounded on the west by Chatsworth Street, on the north by Jefferson Avenue,
and on the south by Juliet Avenue, for a Little League Baseball Diamond.
J+. Said permittee, after the inception of said work,
shall prosecute said work continuously, with diligence,
and fully complete said work to the satisfaction and
approval of the Commissioner of Public Works on or before
July 1, 1961.

Section 2. That the Commissioner of Public Works is hereby

authorized to issue a permit to said Linwood Baseball Association for the
temporary use of said undeveloped real estate of the City of Saint Paul,
upon and subject to said permitteels compliance with the following conditions, viz:
1. Said permittee shall construct a temporary baseball
diamond on said premises entirely at its own cost and
expense, under the supervision and subject to the satisfaction
of the Commissioner of Public Works and in accordance with
plans and specifications approved by said Commissioner,
provided that no Amcture, save a portable fence, shall be
erected by said permittee thereon, and the erection of any

such portable fence thereon shall be subject to compliance

2. Said permittee shall pay the cost of engineering
and inspection of said work, and shall pay the cost of
publication of this ordinance. J
3. Said permittee -shall properly protect all excavations
made in any subject section of real estate, both day and night,
so as to avoid ,ail damage or injury to person or property,
and shall properly fill and_tamp any subject section of
real estate to avoid settling. —
J+. Said permittee, after the inception of said work,
shall prosecute said work continuously, with diligence,
and fully complete said work to the satisfaction and
approval of the Commissioner of Public Works on or before
July 1, 1961.

5. Said permittee empressly agrees and undertakes
to fully' indemnify and hold harmless the City of Saint
Paul, its agents, officers, and employees from any and
dll damages, claims losses, judgments, suits, or empenses
arising, out of or occasioned by -the performance of the
work contemplated by this permission sand authority.
6. Said permittee shall furnish a bond to the City
of Saint Paul in the sum of $102000, condi-l- oned to
comply with all the tez+ms of this ordinance and to
indemnify and save harmless said City from all liability,
loss, judgments, suits, costs, charges, and expense that
may accrue to persons or property occasioned by the
making of the said improvement or arising out of the
same.

7. Said permittee shall discontinue such baseball
diamond use of- -said premises and restore the same to
their former conditioh -and to the satisfaction of said
Commissioner of Public Works in compliance with the
order of the Council of the City of Saint Paul under and
by its resolution, the City hereby reserving its absolute
right to terminate such temporary baseball diamond use
of said premises andany permit hereby authorized therefor
at any time, and it being contemplated that while the
same shall remain operative, said permit shall be limited
to the period between April 1 and October lfbf each subject
calendar year.
8. Said permittee shall, within ten days after the
passage of this ordinance, file a written acceptance
thereof with the City Clerk.
Section 3. This ordinance is hereby declared to be an emergency
ordinance rendered necessary for the preservation of the public peace,
health, and safety.
Section la.. This ordinance shall take effect :and be in force upon
its passage, approval, and publication.

Dear Mrs. O'Connell:
Please be advised that the ordinance granting the Little
League Baseball Association permission to use a parcel of prop-
erty near Jefferson and Chatsworth, Council File No. 199516,
which was laid over at our request, should now be canceled.
An alternate and preferable site for this ball field has
been found so that a new ordinance will be introduced. It is
requested that the Traffic Committee be given an opportunity to
review this new ordinance and proposed site before final adop-
tion by thelCouncil.
