installation of water mains adjacent to said real
estate and extension of water service thereto by
the City acting through its Board of Water Com-
missioners and prescribing terms and conditions
thereto. This is an emergency ordinance rendered
necessary for the preservation of the public
peace, health and safety. ",

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

Section 1. That Ordinance No. 10112,, approved July 1,
1953, hereby is amended in the following particulars, to -wit:

(a) That an additional Section "12 (a) hereby;is
inserted therein,immediately following Section _12 of said
Ordinance, and said additional section shall read as follows,
to -wit: ---..
"Sec. 12 (a). That pursuant to the per-
tinent Supplemental Application of said
Minnesota Mining & Manufacturing Company, owner
of that certain parcel of real estate mentioned
and described in Section 1 hereof, except the
west 50 feet of the east 411.74 feet of the
south 86 feet of the north 221.49 feet and ex-
cept the west 123 feet of the east 361.74 $eet
of the south 201 feet of the north 336..49feet
of the SWI of Section 36, Township ,, 29, Range 22,

hereby permission and authority are granted to said Minnesota Mining
and Manufacturing Company and its successors in interest in respect
of said composite parcel of real estate, for the construction, main-

tenance and operation of the requisite sanitary sewer
service connection therefor and the connection thereto
of said composite parcel c' real estate with the public
sewer system of said Village, at a point in or adjacent
to the south line of Trunk Highway No. 12, also known. as
Hudson Road, a distance of approximately 1000 feet east of
the east line of McKnight Road (hereinabove and hereto-
fore designated as East Avenue),, for the purpose of the
drainage of sanitary sewage and waste materials accumu-
lating on said composite parcel of real estate therefrom
and throughathe said public sewer systems of said Village
and said City and the sewers and sewage facilities of the
Minneapolis -Saint Paul Sanitary District for conduct,
treatment and disposal; that the aforesaid comparable
sewer service connection authorized in Section 1 hereof,- -
between the parcel of real estate therein mentioned and
described and the public sewer system of said City,
henceforth shall be deemed authorized therefor and made
applicable to the said composite parcel of real estates
That the several provisions of Section@ 3 and 4 hereof
relating to Annual Charges and Sewer Rental Charges,
respectively, thereby limited in application to the
separate parcel of real estate mentioned and described in
Section 1 hereof, shall be and hereby are extended in
application to the said composite parcel of real estate,
in its entirety. That the several provisions of Section 8
hereof, relating to the permit thereby limited in appli-
cation to the separate parcel of real estate mentioned
and described in Section 1 hereof shall be and hereby are
extended so that the same henceforth shall apply to all
permits granted hereunder and related to the said composite

inserted therein immediately following said Section 12 (a) of said
Ordinanc4 and said additional Section 12 (b) shall read as follows:
"Sec. 12 '(b). That each such sewer connection
and every other sewer connection for any such or com-
parable'sewer service purpose now or hereafter estab-
lished between said above described composite parcel
of real estate and said Village or said City public
sewer system shall be and hereby is made subject to
the excl-dsive control and regulation in respect of
installation, maintenance and removal, prescribed now
or hereafter under and by pertinent Ordinances, Reso-
lutions, Rules and Regulations of said City of Saint
Paul; that all Annual Charges, Sewer Rental Charges,
and other sewer service chimes for on on account of any
such or /other sewer connection between said above described
real pr6p.6rty and the public sewer system of said Village or
that of-said City, now or hereafter established for any such
or comparable purpose, shall be and hereby are limited and
restricted to such charges as have been or as shall be pre-
scribed and imposed and made collectible therefor by and
for the sole and exblusive benefit of said City; and that
said City does hereby reserve all necessary rights and
privileges therefor and at its option may require said
Minnesota Mining and Manufacturing Company, owner of all
of the said composite parcel of real estate or said
Company's successor in interest.Inn- l-respect of the same,

AN ORDINANCE ACCEPTING AND APPROVING THE TERMS, CONDITIONS
AND PROVISIONS OF ST. PAUL CITY ORDINANCE NO. 1 0112 AS AMENDED
BY ST. .PAUL CITY ORDINANCE NO. 11863 INSOFAR AS THE TERMS OF
SAID ORDINANCE NO. 11863 AFFECT THE VILLAGE OF MAPLEV,OOD.
THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES ORDAIN:
Section 1. That the Village of Maplewood does hereby approve and
accept the terms, conditions and provisions of Sections 12 (a) and 12 (b) of St.
Paul Ordinance No, 10112 as set forth in St. Paul Ordinance No. 11865 providing
in effect that the annual charges and sewer rental charges which are required by
the City of St, .Paul to be paid to said City by Minnesota Mining and Manufacturing
Company shall be paid and accounted for by the said Minnesota Mining and Manufac-
turing Company directly to said City of St. Paul without first being paid o vet
to the Village of Maplewood, provided, however, that the said Village of Maplewood
does hereby not waive any of its rights for the collection of construction costs
and maintenance costs for the sewer lines lying within the Village of Maplewood
through which sanitaky sewage from the said Minnesota Mining and Manufacturing
Company will be discharged into sewage lines within the City of St. Paul.
Sec. 2. This ordinance shall take effect and be in force upon its passage
and publication*
