PERTAINING TO USE DISTRICTS, HEIGHT DISTRICTS AND
REZONING OF CERTAIN PROPERTIES IN THE CITY OF SAINT
PAUL, AS AMENDED. THIS IS AN EMERGENCY ORDINANCE
RENDERED NECESSARY FOR THE PRESERVATION OF THE PUBLIC
PEACE, HEALTH, AND SAFETY.
I
COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64, inclusive,
the Saint Paul Legislative Code, pertaining to Use Districts, Height
tricts, and Rezoning of certain properties in the City of Saint Paul,
amended, be and the same is hereby further amended so as to rezone
following described property from "B" Residence District to "Ctt
idence District, to -wit:
Lots 20 and 21, Block 16, Midway Heights , on the east
side of Tatum Street between Minnehaha and Chelton
Avenues, according to the plat thereof on file and of
fecord in the office of the Register of Deeds in and for
Ramsey County, Minnesota.
Section 2. This ordinance is hereby declared to be an emergency
inance rendered necessary for the preservation of the public peace,
lth and safety.
Section 3. This ordinance shall take effect and be in force
its passage, approval and publication.

This is in the mattez' of the petition of Edmar T. Fink to rezone from "B"
to "C11 residence property located on the east side of Tatum Street be-
tw en Minnehaha and Chelton Avenues and described as Lots 20 and 21,
B1 ck 16, Midway Heights Addition.
On March 22, 1962, the Commissioner of Finance reported the petition suffi-
ci nt with the owners of 15 of a possible 19 (78.9%) tracts of land within
th prescribed 100 foot radius having signed the petition. The site is
pr sently developed with a non- conforming one -story store building which is
di ided into two stores one of which is occupied by a barber shop and the
of er is vacant. The applicant proposes to remove the existing structure
hni develop it with an 11 unit apartment building as stated on the petition.
The site has a frontage of 90 feet on Tatum Street and an average•depth
of 156.25 feet, resulting in an area of approximately 11,600 square feet.
North and adjoining and fronting on Tatum Street are three single - family
re idences; east and across a public alley are the rear yards of single -
fa ily residences fronting on Englewood Avenue; south and adjoining is a
si gle- family residence which was moved onto this property in 1958, farther
so th and fronting on West Minnebaba Avenue are single and two - family resi-
de ces and one recently constructed four - family apartment building; direct -
1 west across Tatum Street is a non - conforming store building with resi-
dential use above; to the northwest across the intersection of Tatum Street
aAd Chelton Avenue are single - family residences.
F eld investigation discloses that the building line in this block is 27
f et as established by three residences in the lblock constructed prior to
t e enactment of the Zoning Code. The construction of an apartment build -
i g on the property would crowd the site, and with a 27 foot required set
b ck, it would not be possible to provide the required off- street parking.

a ea. The•proposed land use plan indicates the highest and best use of
t e property would be for two - family residences.
