THIS IS AN EMERGENCY ORDINANCE RENDERED NECESSARY FOR THE PRESERVATION OF THE PUBLIC PEACE, HEALTH AND SAFETY. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: E NO. E NO. '21,0090 Section 1. 'As used throughout this Chapter the term "vehicle" shall mean any self - propelled motor vehicle, and the term "street" shall mean any street, avenue, highway, or other public way in the City of Saint Paul other than public alleys. Sec. 2. Whenever in the opinion of the Commissioner of Public Works or, in his absence from the City, the Chief City Engineer or, in the absence of both the Commissioner and the Chief City Engineer, some other designated representative of the Commissioner, an emergency exists in the City or in a section or sections thereof because oP snow, freezing3ain, sleet, ice, snow drifts or other natural phenomena which create or are likely to create hazardous road conditions impeding or likely to impede the free movement of fire, health, police, emergency or other vehicular traffic or otherwise endanger the safety and welfare of the community, the Commissioner of Public Works, or his designated representative, may declare an emergency to exist for a period of 144 hours, but such emergency_may,be. sooner - terminated if conditions permit. Notice of such emergency and termination-thereof shall be-given by press, radio or television, which news media shall be requested to cooperate with City officials, and when given, such notice shall constitute due and proper notice. Where in the opinion of the Commissioner of Public Works or his designated representative such emergency continues to exist for a period in excess of the aforesaid emergency period, he is hereby authorized tocbclare successive emergency periods. Sec. 3. During the period of time between a declaration of emergency by the Commissioner of Public Works or his designated representative and the declaration:of the end of such emergency, vehicles shall not be left stopped, parked, abandoned or otherwise tihattended on a street in the City of Saint-Paul except as permitted Eby the following provisions: 9 a. On all primary streets hereinafter set forth vehicles shall not be stopped, parked, abandoned or left unattended between the hours of 10 p.m.. and 11 a.m. of the following day during any period when an emergency has been declared by the Commissioner of Public Works as hereinabove provided or until such time as stow has been plowed from both sides of any such designated primary street during the course of an emergency declared by the Commissioner because of snow. This provision shall not prohibit the stopping of commercial passenger vehicles for periods sufficient to load or discharge passengers from such vehicles. Sec. 7. The payment of such charges shall not relieve the owner or other person responsible for such violation from the payment of any fine or penalty for violation of the provisions of this or any other applicable ordinance of the City of Saint Paul. It shall be unlawful for any person to reclaim the vehicle so removed and stored without first paying all of the said costs, charges, or penalties. Sec. 8. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Sec. 9. This ordinance shall take effect and be in force upon its passage, approval and publication. Sec. 10. This ordinance shall be deemed a part of the Saint Paul Legislative Code and shall be incorporated therein and given an appropriate chapter and /or section number at the time of the next revision of the said Legislative Code. On all streets not designated primary streets as hereinbefore set forth in Section 3a, vehicles shall not be stopped, parked, abandoned or left unattended on streets running in a generally easterly and westerly direction, as shown in red on the City map hereto attached, made a part hereof by reference, and herewith filed with the City Clerk, on even numbered days of the month between the hours of 7 a.m. and 7:30 P.M. on each day of such declared emergency, and on streets running in a generally northerly and southerly direction, as shown in green on the aforesaid City map, on odd - numbered days of the month between the hours of 7 a.m. and 7:30 p.m. on each day of such declared emergency. Where an emergency has been declared because of snow conditions, parking may be resumed on individual streets as soon as snow plowing has been completed on the full width of such street. Sec. 4. Any vehicle stopped, parked, abandoned or otherwise left unattended in violation of Section 3 hereof is hereby declared to be an obstruction to the public streets and shall constitute a misdemeanor. Sec. 5. In the event any vehicle is stopped, parked abandoned or left unattended in violation of the provisions of this ordinance, the Commissioner of Public Works or his representatives, including all employees of the Department of Public Works and employees of the Bureau of Police of the City of Saint Paul, are hereby authorized to remove or cause to be removed any such vehicle parked in violation of the provisions of this ordinance and to have such vehicle towed or otherwise removed to any public or private garage or parking area and to have such vehicle stored in such garage or parking area until claimed by the owner thereof as hereafter provided. Sec. 6. As soon as practicable after the removal of said vehicle parked in violation of the provisions of this ordinance, the CommissJmer of Public Works shall notify the Commissioner of Public Safety of the removal of such vehicle and within 24 hours after such notification the Commissioner of Public Safety shall notify, in writing, the person shown to be the owner of such vehicle by the registration thereof, ofthe following facts: a. A general description of the vehicle together with the license number; b. The approximate time and the reason for removal" and the place to which removed; c. The charge for such removal which shall not exceed the sum of $7.00 for towing plus a daily cost of storage. The aforesaid notice from the Commissioner of Public Safety to the said vehicle owner shall be addressed to the registered owner and shall be deposited with postage prepaid in the United States mails at -Saint Paul, Minnesota, as soon as practicable after receipt by the Commissioner of Public Safety of the aforesaid notice from the Commissioner of Public Works.
