THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the zoning code, chapters 60 to-64,
inclusive, of the Saint Paul Legislative Code, pertaining to Use
Districts, Height Districts, and Rezoning of certain properties,
in the City of Saint Paul, as amended, be and the same is hereby
further amended so as to rezone the following described property
from "B" Residence District to "C" Residence District, to -wit:
Lot 12, Block 7, Rogers Rearrangement, according to
the plat thereof on file and of record in the office
of the Register of Deeds in and for Ramsey County,
Minnesota, being located on the south side of Pacific
Street between Earl and Cypress Streets.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of the
public peace, health and safety.
Section 3. 'This ordinance shall take effect and be in

Dear Madam:
This is in the matter of the petition of Marcella Wiegele to rezone from
"B" to "C" residence property located on the south side of Pacific Street
between Earl and Cypress Streets and described as Lot 12, Block 7, Roger's
Rearrangement.
On May 23 ,1962, the Commissioner of Finance reported the petition suffi-
cient with the owners of 12 of a possible 18 (66 2/3%) tracts of land within
the prescribed 100 foot radius having signed the petition. The property is'
presently developed with a two and one -half story four - family frame residence.
The purpose of the rezoning is to legalize the use. The records,of the County
Assessor's office show this property as having been built between 1912 -1914
as a two - family residence. Their records indicate that in 1954 the property
bad six apartment units. However, at the present time there are four units.
The site has a frontage of 40 feet on Pacific Street and a depth of 128 feet,
resulting in an area of 5,120 square feet. The adjacent and surrounding area
uses are entirely single and two - family type.
Field investigation discloses that the area is predominantly single - family
in character and the highest and best use for this property would be for two -
family use which is permitted under a "B" residence classification. To rezone
to "C" residence would be "spot zoning" and contrary to the spirit and intent
of the Zoning Ordinance.
In consideration of the above factors, the Board of Zoning recommends the
denial of the petition to rezone the above described property to "C" resi-
dence district.
