AN ORDINANCE GRANTING PERMISSION TO THE RIVERVIEW MEMORIAL HOSPITAL; INC. TO CON- STRUCT A PUBLIC SANITARY SEWER IN MOUNT HOPE AVENUE FROM PRESCOTT STREET TO 240 FEET NORTH OF PRESCOTT STREET AND TO GRADE AND SURFACE SAID SECTION OF PUBLIC STREET LYING AND BEING WITHIN THE CORPORATE LIMITS OF THE CITY OF SAINT PAUL. THIS IS AN EMERGENCY ORDINANCE RENDERED NECESSARY FOR THE PRESERVATION OF THE PUBLIC PEACE, HEALTH AND SAFETY. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: SECTION 1 That permission and authority are hereby granted to Riverview Memorial Hospital, Inc. to construct a public sanitary sewer in'Mount Hope Avenue from Prescott Street to 240 feet north of Prescott Street and to gradeiand surface said section of public street lying and'being within the corporate limits of the City of Saint Paul. The following described property is that to be served by such public sewer: Lots 2, 17, 18 and that part of Lot 4 south of the North Line of Lot 17 (produced), Auditor's Sub. #30, ac- cording to plat thereof on file and of record in the office of the Register , of Deeds, Ramsey County, Minnesota. SECTION 2 - - -- The 'Commissioner of Public Works is hereby author -' ' ized to issue a permit to the Riverview Memorial Hospital, Inc. for the construction of said public sewer therein and for the grading and surfacing of said section of public street, upon its compliance with the following conditions, viz: L\ 1. Said permittee shall pay the cost of en- gineering and inspection of said work, and for the publication of this ordinance. 3. Said permittee shall properly protect all excavations made in the streets both day and night so as to avoid all damage or injury to person or property; said permittee shall properly fill and tamp said streets to avoid settling, and shall restore said streets to their original condition; and said permittee shall, according to plans and specifications therefor to be furnished by said Commissioner, restore in respect of surface and other conditions any streets disturbed by said permittee's opera- tions hereunder. 4. Said permittee, after the inception of said work, shall prosecute same continuously with diligence, and fully complete said work to the satisfaction and approval of said Commissioner on or before October 1, 1962. 5. Said permittee expressly agrees and undertakes to fully indemnify and hold harmless the City of Saint Paul, its agents, officers, and employees from any and all damages, claims, losses, judgments, suits, or expenses arising out of or occasioned by its performance of the work contemplated by this permission and authority. 6. Said permittee shall not proceed to construct said sewer or to grade unless and until said permittee shall have fully complied with the provisions regarding insurance and indemnification contained in the City of Saint Paul Department of Public Works Specifications for Street and Sewer Construction dated April 1, 1959, Section numbered 1.44, as amended, and found on pages 1 -13 through 1 -17 of said Specifications applicable to contractors. For the pur- poses of this ordinance, the aforesaid section of said Speci- fications numbered 1.44, as amended, shall be read as though the word "permittee" were substituted for the word "contractor" wherever the same appears in the aforesaid Section 1.44. Said Section 1.44, as amended, of the Specifications for Street and Sewer Construction in the City of Saint Paul is hereby incor- porated hereby by1 reference as fully and as completely as if set forth herein verbatim. Proof of complianQe with the pro- visions of the aforesaid Section numbered 1.44, as amended, shall be in such form as the Corporation Counsel of the City of Saint Paul may direct, and the documents required by the aforesaid Section shall, after submission to the Corporation Counsel, be filed in the office of the Comptroller of the City of Saint Paul. Said permittee shall furnish a bond to the City of Saint Paul in the sum of Ten Thousand Dollars ($10,000) conditioned to comply with all the terms of this ordinance and to indemnify and save harmless said City from all liability, loss, judgments, suits, costs, charges, and expense that may accrue to persons or property occasioned by the making of the improvement or arising out of same. 8. Said p ermittee shall, within ten days after the passage of this ordinance, file a written acceptance thereof with the City Clerk. SECTION 3 This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preserva- tion of the public peace, health, and safety. SECTION 4 This ordinance shall take effect and be in force from and after its passage, approval,and publication. SECTION 5 Ordinance No. 12212, approved June 9, 19622 hereby is repealed. PAUL INTER - OFFICE COMMUNICATION z��8b5 a TO: Commissioner Milton Rosen FROM: Grege Beckett DATE: June 26, 1962 On Wednesday morning, June 27th, ordinances will be presented to the City Council for their first readings granting permission to the Riverview Memorial Hospital, Inc. to construct a public sanitary sewer in Mount Hope Avenue from Prescott Street to 240 feet north of Prescott Street and also for the grading and surfacing of Mount Hope Street in this same area. Frederick Bradford, attorney for the River- view Memorial Hospital, will appear before the Council and ask for informal approval so that work may be exp6dited as soon as possible. If the Council desires to grant this informal approval, it should be done contingent on the fact that they a with all the terms as set up in the ordinance before proceeding with any con - stiuction work.
