That the Zoning Code, Chapters 60 to 61r inclusive, of the Saint Paul Legislative Code, as amended, pertaining to Use Districts, Height Districts and Rezoning of certain properties in the City of SaYnt Paul, be and the same hereby is further amended so as to rezone the following described property from "B" Residence District to "C" Residence District: Lot 5, Block 6, Edmund Rice's first addition to St. Paul, according to the plat thereof on file and of record,in the office of the Register of Meeds in and for Ramsey County, Minnesota, located on the west•side of Clark Street between Vhitall Street and York Avenue, subject to the following express exceptions and conditions: 1. As a consequence of the splendid cooperation received from Mr. Schroeder and Mr. Schnarr in the City Architect's Office, I have been able to ascertain from their file that the property in question, although zoned "B- Residence" for these past many years, has been operating as a four -plex since 1937. My clients purchased this property in September, 1961, completely unaware of the zoning as a "B- Residence" and since expended approximately $6, 000 in the reconstruction and repair of this building. We seek here only the change from IT-Residence District" to I'C- Residence District" for the purpose of bringing this non - conforming use into conformance. As I intend to be out of town, during the month of July, I would not want this matter to come before the Council. before I return. O'Connell city Clerk Building Dear Madam: This is-in the matter of the petition of Petro Krenza to rezone from "B" to "C" residence property located on the west side of Clark Street between Whitall Street and York Avenue and described as Lot 5, Block 6, Edmund Rice's 1st Addition. On June 19, 1962, the Commissioner of Finance reported the petition sufficient with the owners of 13 of a possible IS (72%) tracts of land within the prescribed 100 foot radius having signed the peti- tion. The site is developed with a two- family structure which is generally in a poor state of repair. The structure has from time to time been used as a residence by four families in violation of the Zoning Code. The purpose of the rezoning is to legalize the use of the site for four families. The depth of the lot is 132 feet and the frontage is 50 feet, resulting in an area of 6,600 square feet. The immediate area is developed with single - family residences with some vacant property. Field investigation discloses that the proposed use would not be compatible with the other land uses in the neighborhood and that the rezoning would constitute "spot zoning." The proposed land use plan indicates the highest and best use of the property is for single and two - family use. In discussing the matter with the City Architect, it was stated that the condition of the structure is such that it is in violation of the Building Code in many respects. Based upon the development of the immediate area and the proposed Land Use Plan, the Board of Zoning recommends the denial of the petition to rezone the above described property from "B" to "C" residence.
