AN ORDINANCE AMENDING THE ZONING CODE, CHAPTERS
60 To 649 INCLUSIVE, OF THE SAINT PAUL LEGISLA-
TIVE CODE, PERTAINING TO USE DISTRICTS, HEIGHT
`DISTRICTS AND REZONING OF CERTAIN PROPERTIES IN
THE CITY OF SAINT PAUL, AS AMENDED. THIS IS AN
EMERGENCY ORDINANCE - RENDERED NECESSARY FOR THE 7
PRESERVATION OF THE PUBLIC PEACE, HEALTH, AND
SAFETY.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to
64, inclusive, of the Saint Paul Legislative Code, pertain-
ing to Use Districts, Height Districts, and Rezoning of cer-
tain properties in the City of Saint Paul, as amended, be
and the same is hereby further amended so as to rezone the
following described property from "All Residence District to
Commercial District, to -wit:
Lot 39, Block 16, Hayden Heights Addition,
according to the plat thereof on file and
of record in the office of the Register
of Deeds in and for Ramsey County, Minnesota,
being locatedcn the north side of Ivy Avenue
between White Bear Avenue and Hazel Street;
subject to the following express exceptions and conditions:
1. That, subject to any further reclassifica-
tion of the hereinabove described real estate by
virtue of proceedings therefor hereafter instituted,
conducted and completed according to applicable pro-
visions of said Zoning Code, as amended, and appli-
cable provisions of the statutes of the State of
Minnesota, hereby, the employment of said real estate
henceforth is restricted and limited to the following
'1g specified uses, to -wit: (a) Residential District uses
permitted by the regulatory provisions of the sE.d
p Zoning Code, as amended, in "All Residence District,
"B" Residence District, and "C" Residence District,
thereby established, and (b) Commercial Uses which
� shall include no more than the establishment, main -
o tenance and conduct of a hair dressing and beauty
culture shop, subject to all applicable statutes,
ordinances, rules and regulations prescribed and pro-
mulgated by governmental agencies having cognizance,
and without the use or employment of .any advertising
sign or placard pertaining to the same.

2. That the owner of said real estate, within
the period of 60 days next succeeding the publica-
tion of this ordinance, shall file with the City
Clerk, in two fully executed counterparts, said
owner's written acceptance of this ordinance,` in-
corporating, among other things, said owner's grant
unto said City of Saint Paul of a negative easement
affecting said real estate, for the imposition,
maintenance and enforcement of the aforesaid re-
strictions and limitations upon the employment a nd
use of the hereinabove described real estate, ap-
proved as to form and execution by the Corporation
Counsel and recordable in the office of the Register
of Deeds. That said owner's written acceptance by
apt provisions further shall obligate said owner and
the assigns of said owner in regard to said real
estate, to effectively consent to the rezoning of
said real estate to "A" Residence District, upon
the resolution of said Council requesting the same,
in the event of the cessation for a continuous period
of twelve months, of the use of said premises for
said permitted single commercial purpose.
3. That, in addition to other requirements
therefor, said written instrument of acceptance
shall incor copy ,
porate a certified co of this ordinance
and immediately upon the aforesaid filing of the same
the City Clerk shall cause one of such counterparts
thereof to be filed of record in the office of the
Register of Deeds in and for Ramsey County, Minnesota.
Section 3. This ordinance shall take effect and
be in force upon its passage, approval and publication.

An ordinance amending the Zoning

twining to Use 'Districts, Height Dis-

Legislative Code, pertaining to Use
Districts, Height Districts, and Rezon-
ing of certain properties in the City
of Saint Paul, as amended, be and the
same is hereby further amended'so
as to rezone the following described
property from "A" Residence District
to Commercial District, to -wit:
Lot 39, Block 16, Hayden 'Heights
Addition, according to the plat
thereof on file and of record in the
office of the Register of Deeds in _
and for Ramsey County, Minnesota,
being located on the north side of
Ivy Avenue between White Bear '
Avenue and Hazel Street;
subject to the following express ex-
ceptions and conditions:
1. That, subject to any further re-
classification of the hereinabove de-
scribed real estate by virtue of pro-
ceedings therefor hereafter instituted,
conducted and completed according to
applicable provisions of said Zoning
Code, as amended, and applicable pro-
visions of the statutes of the State of
Minnesota, hereby, the employment of.
said real estate henceforth is restricted
and limited to the following specified
uses, to -wit: (a) Residential District
uses permitted by the regulatory pro -;
visions of the said Zonmg Code, as
amended, in "A" Residence District,
"B" Residence District, and "C" Resi,.
dence District thereby established, and
,(b) Commercial Uses which shall in -'
Cclude no more than the establishment,'
maintenance and' conduct of a hair
dressing and beauty culture shop, sub -
ject to all applicable. statutes, ordi-
nances, rules and regulations pre-
scribed and promulgated 'by govern-
mental agencies having cognizance;
and without the use or employment of
,any advertising sign or placard per-
taining to the same.
2. That the owner of said real
estate, within the period of 60 days
next succeeding the publication of
this ordinance, shall file with the. City'I
Clerk, in two fully executed counter-
parts, said owner's written acceptance
of this ordinance, incorporating, among
other things, said owner's grant unto
said City of Saint Paul of a negative
easement affecting said real estate, for
the imposition, maintenance and en-
forcement of the aforesaid restrictions,
and limitations upon the employment
and use of the hereinabove described
real estate, approved as to form and
execution by the Corporation Counsel
and ,recordable in the office of the
Register of Deeds. That said owner's
written acceptance by apt provisions
further shall obligate said owner and
the assigns of said owner in regard to
said real estate, to effectively consent
to the rezoning of Said real estate to
"A" Residence District, upon the reso-
lution of said Council requesting the
same, in the event of the cessation for
a continuous period of twelve months;
of the use of said premises for said
permitted single commercial purpose:
3. That, in addition to other re-
quirements therefor, said written in-
strument of acceptance shall incorpo-
rate a certified copy of this ordinance,
and immediately upon the aforesaid
filing of the same the City Clerk shall
cause one of such counterparts thereof
to be flied of record in the office of
the Register of Deeds in and for
Ramsey County, Minnesota.
SECTION 3
This ordinance shall take effect and
be in force upon its passage, approval
and publication.

The City Council requested that you prepare an ordinance granting the
attached petition for rezoning from "A" Residence to Commercial Distiict
Lot 39,-Block 16, Hayden Heights Addition, located on the north side of
Ivy Ave. between White Bear Ave. and Hazel St., subject to a negative
easement limiting the Commercial use,to that of a beauty shop operated
by the petitioner, as more fully set.out in the attached letter of the
Zoning Board. .�
PETITION TO REZONE ,
A petition having been filed request-
ing that Chapters 60 to 64 inclusive,
St. Paul Legislative Code, re Zoning,
etc., be amended so as to rezone prop-
erty described as Lot 39, Block 16,
Hayden Heights, also described as
1823 E. Ivy Ave., to Commercial Dis-
trict, the Council of the City of Saint
Paul has fixed the 17th day of October,
1963, at ten o'clock in the forenoon
in the Council Chamber in the City
Hall of said City, and at said time
and place, the Council will hear all
persons and all objections and recom-
mendations relative to said proposed

This is in the matter of the petition of Louise C. Weston to rezone
from "A" residence to commercial property located on the north side
of Ivy Avenue between White Bear Avenue and Hazel Street which is
described as Lot 39, Block 16, Hayden Heights Addition.
On September 18, 1963, the Commissioner of Finance reported the
petition sufficient with the owners of 18 of a possible 19 (94.737o)
tracts of land within the prescribed 100 foot radius having signed
the petition`. The site is developed with a single - family residence
and it is proposed to install a beauty shop in the basement. The
subject property consists of one platted lot with a frontage of 40
feet on the north side or Ivy Avenue and a depth of 125.52 feet, re-
sulting in an area of approximately 5,021 square feet. All of the
surrounding area is developed with single - family residences.
The Board of Zoning considered this matter at its regular meeting
on September 26, 1963, and recommends the granting of the petition
to rezone the above described property to a commercial district
subject to a negative easement limiting the commercial use to that
of a beauty shop operated by the petitioner, and providing that the
;property would revert back to an "A" residence district when the
use is discontinued, or the property is sold.
