S r .. - �7 �l1� �lnarJoeL�- AN ORDINANCE AMENDING THE ZONING CODE, CHAPTERS 60 TO 64, INCLUSIVE, OF THE SAINT PAUL LEGIS- LATIVE CODE, PERTAINING TO USE DISTRICTS, HEIGHT DISTRICTS AND REZONING OF CERTAIN PROPERTIES IN THE CITY OF SAINT PAUL, AS AMENDED. THIS IS AN EMERGENCY ORDINANCE RENDERED NECESSARY FOR THE PRESERVATION OF THE PUBLIC PEACE, HEALTH, AND SAFETY. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAINS Section 1. That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul Legislative Code, pertain- ing to Use Districts, Height Districts, and Rezoning of certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following described property from "B ".Residence District to "C" Residence District, to -wit: Lots 10 through 21, inclusive, Block 5, Fairchild & Howard's re- arrangement of part of Tracy Outlots, according to the plat' thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota, being located on the west side of Birmingham Street between '--,Case and York Streets. Section 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preserva- tion of the public peace, health and safety. Section 3. This ordinance shall take effect and be in force upon its passage, approval and publication. O'Connell City Clerk Building Dear Madam: This is in the matter of the petition of John Bloomquist to rezone from "B" to "C" residence property located on the west side of Birmingham Street be- tween Case and York Streets which is described as Lots 10 thru 21 inclusive, Block 5, Fairchild and Howard's Rearr. of part of Tracy's Outlots. _J On September 11, 1963, the Commissioner of Finance reported the petition suffi- cient with the owners of 26 of a possible•28 (92.75%) tracts of land within the prescribed 100 foot radius having signed the petition. The subject property is vacant and at the street grade of the adjoining streets. At one time, this property was included in the proposed right -of -way for the rerouting of High- way # 212. The Highway Department has recently advised us that due to a change in the proposed alignment; this property is no longer included in their plans. As indicated nn the petition, it is proposed to construct a 2J story boarding -care home with an-capacity-of -'112 beds. The proposed structure will be, constructed on Lots 10 thru 14 and the vacated alley adjoining said lots. There is no building proposal submitted for Lots 16 thru 21 at this time. The subject property consists of 12 platted lots and part of a vacated alley and is irregu- lar in shape baving a frontage on the south side of Case Avenue of 172.55 feet, 442.93 feet on the west side of Birmingham Street and 178.22 feet.on the north side of York Avenue, resulting in an area of approximately 59,393 square feet. North and across Case Avenue is a truck - garage and storage yard of the Bell Telephone Company which was recently constructed; to the east and across un- improved Birmingham Street is vacant land recently classified in the "C" resi- dence district and proposed for apartment development, also one recently constructed single - family residence fronting on said street; to the south and across unimproved York Avenue is vacant land classified in the "B" residence district; west and adjoining is vacant land classified in the "B" residence district. Field investigation discloses that,'because of the commercial con- struction to the north and the "C" residential classification to the east, that this proposal would permit a use which would be compatible with the existing and proposed uses in the area and provide a proper transitional use between these uses and the residential classification to the south and west. In consideration of Pbe above factors, the Board of Zoning recommends the granting of the petition to rezone the above described property to a "C" residence district. HCW:FGI Encl. Z.
