PAUL AVE. AND NORTHERLY OF A LINE 140 FEET NORTH OF AND PARALLEL TO THE NORTH LINE OF WILMOT AVE. PRODUCED ACROSS SID LOTS "159 169 179 22 AND 23, SNELLING OUTLOTS, RAMSEY COUNTY. THIS IS AN EMERGENCY ORDINANCE RENDERED NECESSARY FOR THE PRESERVATION OF THE PUBLIC PEACE, HEALTH AND SAFETY. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAINS SECTION 1 That permission and authority are hereby granted to Rein Development Company to construct a public sanitary sewer and public storm sewer in,and through a certain per- petual public easement herein provided to be granted or caused to be granted by said permittee to the City of Saint Paul as a condition precedent to the effect of such grant of permission and authority hereunder, such public sewers to serve a tract of land described as that part of Lots 15, 16, 179 22 and 23 lying south of St. Paul Ave. and northerly of a line 140 feet north of and parallel to the north line of Wilmot Ave,_, oduced across said Lots 15, 169 179 22 and 23, Snelling Outlots, Ramsey County_, and such public sewers' to be constructed in such perpetual,public sewer easement in lands described as, follows: 141 - 1:5 Z1 ,v " Attest: City • Clerk 8-82 X22 f "A 20.0 foot wide permanent easement for con - structing and maintaining a public sewer, on, under, across and through Lots 15, 16, 179 22 and 23, Snelling Outlots, the centerline of said easement being a line that is 165 feet south of the south line of St. Paul Ave. and extending easterly from Davern Ave. approxi- mately 1150 feet to a point on the above de, scribed centerline that is 142.0 feet west of the west line of unimproved Snelling Ave." Councilmen Nays Dalghsh Holland Loss Mortinson f Peterson Rosen Mr. President (Vavoulis) 'r t � ,c Passed by the Council In Favor Against Approved: Mayor a 214984 That the subject public sewers and the center line of the same, affecting locations within the corporate limits of said City of Saint Paul are described as follows: "Construct a public sanitary sewer and a public storm sewer in a 20.0 foot wide ease- ment (to be deeded); the centerline of said sanitary sewer being described as being a line 167.25 feet,south of and parallel to the south line of St. Paul Ave. and extending from Davern Ave. approximately 1140 feet-east of,' Davern Ave. to a point 152.0 feet west of tie west line of unimproved Snelling Ave.;: the centerline of said storm sewer being described as a line 161.25 feet south of and parallel to the south line of St. Paul Ave. and extending from Davern Ave. approximately 1130 feet east of Davern Ave. to a point 162.0 feet west of the west line of unimproved Snelling Ave." SECTION 2 That the Commissioner of Public Works hereby is, authorized to issue a permit to Rein Development Company for the construction of such public sewers, upon and subject to the following provisions, terms and conditions: 1. That said permittee shall construct said sewers entirely at its own expense, under the super- vision and to the satisfaction of the Commissioner of Public Works, and in accordance with the'plans and specifications prepared by him. 2. That said permittee shall pay the cost of engineering and inspection of said work, and for the publication of this ordinance. 3. That said permittee shall properly protect all excavations made in the streets both day and - night so as to avoid all damage or injury to persons or property; shall properly fill and tamp said streets to avoid settling and shall restore said streets to their original condition. 4. That said permittee, after the inception of said work, shall prosecute same continuously with diligence, and fully complete slid work to the satis- faction and approval of said Commissioner on or be- fore October 15, 1964. 5. That said permittee expressly agrees and undertakes to fully indemnify and hold harmless t1id City of Saint Paul, its agents, officers, and employees i J - 3 - 214984 Ms1� from any and all damages, claims, losses, judgments, suits, or expenses arising out of or occasioned by the performance of the work contemplated by this permission and authority. 6. That said permittee shall furnish a bond tc the City of Saint Paul in the sum of $10,000 con- ditioned to comply with all the terms.of this ordi- nance and to indemnify and save harmless said City from all liability, loss, judgments, suits, costs, charges, and expense that may accrue to persons or property occasioned by the making of the improvement or arising out of same. 7. That said permittee shall not proceed to con- struct said sewers unless and until said permittee shall have fully complied with the provisions regard- ing insurance and indemnification contained in the City of Saint Paul Department of Public Works Speci- fications for Street and Sewer Construction dated April 1, 1959, Section numbered 1.44 of said Speci- fications, as amended, applicable to contractors. For the purposes of this ordinance, the aforesaid section of said Specifications numbered 1.44, as amended, shall be read as though the word "permittee" were substituted for the word "contractor" wherever the same appears in the aforesaid Section_1.44, as amended. Said Section 1.44, as amended, of the Specifications for StreEt and Sewer Construction in 4 the.- City_,_of Saint Paul is hereby incorporated herein by 'referenceTas fully and as completely 'at -i£-- set r forth herein verbatim. Proof of compliance with the' provisions of the aforesaid Section, as amended, shall be in such form as the Corporation Counsel of the City of Saint Paul may direct, and the documents required by the aforesaid Section 1.44, as amended, shall, after submission to the Corporation Counsel, be filed in the office of the Comptroller of the City of Saint Paul, 8?. That the said permittee shall, within thirty days after the passage of this ordinance, file a written acceptance thereof with the City Clerk. 9.
