'THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to
64, inclusive, of the Saint Paul Legislative Code, pertain-
ing to Use Districts, Height Districts, and Rezoning .of
certain properties in the City of Saint Paul, as amended,
be and the same is hereby further amended so as to rezone
the following described property from "A" Residence District
to "C" Residence District, to -wit:
Lots 1 through 8, inclusive, Block 5,
St. Clair St. and Short Line Addition
to the City of St. Paul, Plat 2, ac-
cording to the plat thereof on file and
of record in the office of t$e Register
of Deeds in and for Ramsey C6unty,
Minnesota, being located at,the south-
'" west corner of Dunlap Street and Osceola
Avenue.
Section 2. This ordinance is hereby declared
to be an emergency ordinance rendered necessary for the
preservation of the public peace, health and safety.
Section 3. This ordinance shall take effect
and be in force upon its passage, approval and publication.

This is in the matter of the petition of John J. Sullivan to rezone from
"A" to "C" residence property located at the southwest corner of Dunlap
Street and Osceola Avenue which is described as Lots 1 thru 8 inclusive,
Block 5, St.Clair Street and Short Line Addition Plat 2.
On June 4, 1963, the Commissioner of Finance reported the petition suffi-
cient with the owners of 9 of a possible 11 (81.820) tracts of land within
the prescribed 100 foot radius having signed the petition. On January 6,
1962, the City Council established a 15 foot building line setback from
Osceola Avenue for the north 75 feet of Lots 1 thru 6 inclusive. It is
proposed to develop the site with two 23 -unit apartment buildings which
will front on Dunlap Street. The subject property is irregular in shape
having a frontage of 236 feet on the west side of Dunlap Street and 249.11
feet on the south side of unimproved Osceola Avenue and 166.55 feet on the
south property line, resulting in an area of approximately 49,047 square
feet. North and across unimproved Osceola Avenue is a single - family resi-
dence which fronts on Dunlap Street; east and northeast across Dunlap Street
are single- family residences which front on Dunlap Street and Osceola Avenue;
directly south and adjoining is a recently constructed 23 unit apartment
building; west and adjoining at a grade which is approximately 20 feet below
the subject property is the Chicago, Milwaukee, St. Paul and Pacific Railway
right -of -way and trackage, as well as the Short Line roadway right -of -way.
Field investigation discloses that the site, which is vacant, has been
filled to the grade of Dunlap Street. The proposed Land Use Plan indicates
the highest and best use of this property is single and two - family homes.
The Board of Zoning considered this matter at their regular meeting on
July 18, 1963 and because of the proximity of the railroad right -of -way
and the existing apartment building adjoining on the south, believe this
would be a proper transitional use for the property, Therefore, the Board
recommends the granting of the petition to rezone the above described pro-
perty to a "C" residence district.
