UNDER THE ALLEY IN GRUBE'S SUBDIVISION
OF BLOCK 97, LYMAN DAYTONS ADDITION TO
ST. PAUL. THIS IS AN EMERGENCY ORDINANCE
RENDERED NECESSARY FOR THE PRESERVATION
OF THE PUBLIC PEACE, HEALTH, AND SAFETY.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority are hereby
granted to The Church of the Sacred Heart for its construction
of 3/4 inch, 2 inch, and 3 inch electrical conduits, 1 1/2 inch
gas pipe_and a 15 inch corrugated steel conduit containing a
steam line and a condensate pump discharge line, all to be
constructed in'and under the alley in Grube's Subdivision of
Block 97, Lyman Daytons Addition to St. Paul, said conduits and
pipes to be placed in and under said alley as follows:

to cross said alley at a point approximately
90 feet west of the west line of Mendota Street;
b. Said 3/4 inch electrical conduit, said 1 1/2
inch gas pipe, and said 15 inch corrugated
steel conduit to be constructed in the south
side of said alley from approximately-205 feet
west of the west line of Mendota Street and

_ running westerly approximately.70 feet.
Sec. 2. That the Commissioner of Public Works is
hereby authorized to issue a permit to The Church of the

Sacred Heart for the aforesaid construction upon said permittee's
compliance with the following conditions:
1. Said permittee shall construct all said conduits

3. Said permittee shall properly protect
all excavations made in subject alley,
both day and night, so as to avoid all
damage or injury to person or property,,
and shall properly, fill and tamp all;
subject alley or other areas affected to
avoid settling.
4. Said permitl td-6. after the inception of said
work, shall prosecute same continuously with
diligence, and fully complete said work to the
satisfaction and approval of the Commissioner
of Public Works at the earliest possible date,
but in no event later than July 1, 1963.
5. Said permittee expressly agrees and undertakes
to fully indemnify and hold harmless the City
of Saint Paul, its agents, officers, servants
and employees from any and all damages, claims,
losses, judgments, suits or expenses arising out
of or occasioned by the performance of the work
contemplated by this permission and authority.
6. Said permittee shall furnish a bond to the City
of Saint Paul, in the sum of $10,000.00, conditioned
to comply with all the terms of this ordinance, and
to indemnify and save harmless said City from all
liability, loss, judgments, suits, costs, charges,
and expenses that may accrue to persons or property
occasioned by said work or arising out of the same.
7. Said permittee shall, within thirty days after the
passage of this ordinance, file with the City Clerk,
a written acceptance of this ordinance, its terms and
conditions.
Section 3. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of the public
peace, health, and safety.
Section 4. This ordinance shall take effect and be in force
upon its passage, appro -val and publication.
