The Council of the City of Saint Paul Does Ordain: SECTION 1 That the Zoning Code, Chapters 6( to 64 inclusive, of the Saint Paul Leg. islative Code, as amended, pertaining to Use Districts, Height Districts anc Rezoning of certain. properties in the City of Saint Paul, be and the same is hereby further amended so as tc rezone the following described prop- erty from "A" Residence District tc Commercial District: Lot 16 except the west 12 feet thereof, and the west 28 feet of Lot 17, Block 23, Lane's Highland Park, according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota, being located on the north side of Saunders Ave- nue between Davern Street and Snelling Avenue; subject to the following express ex- ceptions and conditions: L That, subject to any further reclass- ification of hereinabove described real estate by virtue of proceedings therefor hereafter instituted, con- ducted and completed according to applicable provisions of said Zoning Code, as amended, and applicable Provisions of the statutes of the State of Minnesota, hereby, the employ- ment of said real estate henceforth is restricted and limited to the fol- lowing specified uses, to -wit: (a) Residential District uses permitted by the regulatory provisions of the Said Zoning Code, as amended, in "A" Residence District, and (b) ,Com- mercial uses which shall include no more than the establishment, main- tenance, and conduct of a single own- er operator hair dressing and beauty culture shop, subject to all applic- able statutes, ordinances, rules and regulations prescribed and ppromul- gated by governmental agencies hav- in g g cognizance, and without the use or employment of any advertising sign or placard pertaining to the same. 2. That the owner of said real estate, within the period of 60 days next succeeding the publication of this ordinance, shall file with the City Clerk, in two (2) fully executed counterparts, said owner's written acceptance of this ordinance, in corporating among other things, said owner's i grant unto said City of Saint Paul of a negative ease- ment affecting said real estate for the imposition, maintenance and enforcement of the aforesaid restric- tions and limitations upon the em- ployment and use of the hereinabove described real estate, approved as to form and ,execution by the Cor- poration Counsel and recordable in the office, of the Register of Deeds. 3. That, in addition to other require- ments therefor, said owner's written acceptance and grant of negative easement shall incorporate a cer- tified copy of this ordinance, and im- mediately upon the aforesaid filing of the same the City Clerk shall cause one of such counterparts thereof to be filed of record in the office of the Register of Deeds in and for Ramsey County, Minnesota. SECTION •2 This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health, and safety. He requests the proposed ordinance amendment rezoning the above described property from "A" to "C" Reidence being limited to the operation of a beauty shop without any external advertising, be amended in the following particulars: That Paragraph 1 (a) be amended so as to eliminate the reference to "B" Residence District and "C" Residence District ". Mr. and Mrs. Brown have no objection to the elimination of this language from the proposed ordinance. In the Pioneer Press of Friday, March 29, 1963, appeared a story stating that an anonymous writer had complained of the rezoning, alleging that it would be prohibited by a deed restriction. I have examined the original records in the office of the Registrar of Titles in connection with this prop- erty and wish to advise as follows: 1. On May 21, 1948 the Al Johnson Construction Co., a Delaware corporation, obtained title to the land - Certificate of Title #117166, and contained in Book 295, Registrar of Titles, Page 78. 2. The next record owner is Larson Building Co., a Minnesota cor- poration, and its title is recorded in Certificate +117178 in Book 295, Registrar of Titles, Page 90. This transfer was effected by Document 256217, and covers only the property presently known as 1631 Saunders. This deed contained a restriction, which in my opinion is personal in nature to the Larson Building Co., who apparently no longer own any land in this area. O'CONNELL SPECIAL ASSISTANT Re: Pending Ordinance Council File No. 211747 for the amendment of the Zoning Code so that thereunder the following described real estate shall be rezoned from "A" Residence District to Commercial District: Lot 16 except the west 12 feet thereof, and the west 28 feet of Lot 17, Block 23, Lane's Highland Park, according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota, being located on the north side of Saunders Avenue between Davern Street and Snelling Avenue The said pending ordinance will come before the Council for fourth reeiding and enactment of the same to- morrow. The subject real estate is registered as held in private ownership under a Registered Certificate of Title on file and of record in office of the Registrar of Titles in and for Ramsey County, Minnesota. The said Certificate of Title incorporates a reference to the effect that the same is subject to a restriction upon its use limiting the same to single family dwelling purposes and improvements. The said reference relates to a purported restriction, of such import under a Deed of Conveyance, in the Certificate of Title. The purported restriction depends upon private contract provisions enforceable only as and to the extent that the same may be determined valid and effedtive between the private parties, grantor and grantee, under said Deed of Conveyance and their successors in interest. The last Deed of Conveyance affecting said real estate and under which the present owner holds the same, contained no reference to said purported restriction. Nevertheless, the Registrar of Titles mentioned the same in the current Certificate of Title. The validity or invalidity of said purported restriction would be properly resolved, between private parties and if found to be a valid and subsisting restriction, would repre- sent a private right for the maintenance and enforcement of the same which might be released by the private owner of the same. Said purported restriction resultant merely from private contract would not constitute a bar to the propm d rezoning of said real estate under the Zoning Code. Suc To the Council - 2 - April 3, 1963 rezoning could not destroy or impair either the validity or enforceability of said purported restriction. In Strauss v. Ginzberg, 15 N.W. 2d 130, 134, the Minnesota Supreme Court stated the principle that a zoning ordinance cannot tffect the obligation created by a restriction on the use of real estate imposed by private contract. The Court there said: "****The zoning ordinance cannot affect the obligtion created by such restrictions and cannot impair the contractual obligation so created. Zoning ordinances, if less stringent, do not diminish the legal effect of private re- strictions. Smith, Zoning Law and Practice, § 3; Metzenbaum, Law of Zoning, p. 282(d)." The purported restriction by private contract by its terms operates until December 1, 1970. The same had been made the subject of a recent letter pertinent to the proposed rezoning, by John E.
