Loss ORDINANCE NO.- An Ordinance amending Section 60.24 of Chapter 60 of the Saint Paul Legislative Code, pertaining to zoning and providing specific density and land coverage minimums as amended, by Ordinance No.12758, approved July 25, 1964. This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. I THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: .F Section 1`. That Section 60.24 of Chapter 60 of the .Saint Paul Legislative Code, as amended by Ordinance No. 12758, approved July 25, 1964, hereby is further amended by inserting therein and adding thereto immediately following Subparagraph c of the same the following additional Subparagraphs d and e: "d. Nothing herein contained shall require any change in the plans, specifications, site, construction or designated use of any building for which a City of Saint Paul Building Permit was issued prior to August 24, 1964,, or the plans and specifications for which, together with an application for the issuance of a City of Saint'Paul Building Permit therefor, were on file with the Commissioner of Parks and Recreation;,;and Public Buildings prior to August 24, 1964, and on said date, and the City 'of Saint Paul Building Permit for the erection of which '!shall have been issued within ninety (90) days next after said date and the construction of which, in either case, shall have been diligently prosecuted and completed, within one (1) year next after the"-date of such Building Permit, or within such additional period of time as the Couneil, by Resolution, for good cause may allow therefor and which in no case shall exceed two (2) years, according'to such plans and specifications therefor filed with said Commissioner in conformity with the pertinent requirements of the Building Code provisions of the Saint Paul Legislative Code. ]j e. U a' F Page 2. f 'E struct,ion of which, in either case, shall have been diligently prosecuted and completed wi$1in one (1) year next after the date of such Building Permit or within such additional period of time as the 6ouncil, by Resolution, for good cause may allow therefor and which in no-case shall exceed two (2) years, according to them plans and specifications therefor filed with said Commissioner in conformity with the pertinent requirements of thelBuilding Code provisions of the Saint Paul Legisla- tive Code. Provided that nothing herein shall authorize any use of any land or the construction of any building thereon which would not have conformed to the Zoning Code or the Building Code provisions, or permissable variations of the same, which would have been applicable to any;;such case, immediately prior to August 24, 1964 when the earlier of the subject Building Permit or Use Permit applications was filed. Provided further that in any such case, where the Building Permit was issued or the application therefor or the application of the Use Permit was filed, the exercise of the Building Permit and the authority for_its issuance and that for the issuance of the Use Permit shall be governed by the said Zoning Code and Building Code provisions as the same were con- stituted immediately prior to the effective date of said amendat' ©ry Ordinance No. 12758. e Section;,2.
