ORDINANCE NO 1.2 �� 3 An ordinance authorizing the Alexander Construction Company,' 4641 Hiawatha Avenue, Minneapolis, Minnesota, to place concrete rubble in the low area of City property located west of Snelling Avenue between the Great Northern and Northern Pacific Railway tracks. This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCILfOF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That permission and authority be and the same hereby are given to the Alexander Construction Company to place concrete rubble and excavation material in the low area of property owned by the City of Saint Pail and located west of Snelling Avenue between the Great Northern and Northern Pacific Railway tr� cks. Sec. 2.- The Commissioner of Public Works is hereby authorized to issue a: permit to the Alexander Construction Company for the placing of concrete rubble and excavation material on said City property with the following express conditions, viz: 1. The said permittee shall place -said concrete rubble and excavation material at its own expense, to the satisfaction and under the supervision of the Commissioner of Public Works. 2. The rubble and excavated material shall be placed as directed by the 'Commissioner of Public Works in the portion of the City property adjacent to the Great Northern Railway Company property. 3.i Sufficient granular material shall be placed with said rubble and material to eliminate voids in the filled area. 4 A bulldozer or other suitable compacting and spreading fequipment shall be furnished by the Alexander Construction' Company, and operated by them to insure compaction. l 5. No combustible materials stumps or logs shall be deposited in the area. 6. The fill shall not be carried above a general elevation described as two feet below the top of subgrade on the Great Northern Track and the top twelve inches shall ` be composed of earth, sand or gravel free from debris. 1 7. Said permittee shall furnish a surety bond to the City of Saint Paul in the sum of Ten Thousand Dollars ($10,000) conditioned to comply with all the terms of this ordinance — �L r Original to City Cleric' PRESENTED BY ORDINAPiCE COUNCIL FILE NO, ORDINANCE NO. /"7Q 3, Page 2. and to indemnify and save harmless said City of Saint Paul from all liability, judgments, suits, costs, charges, damage or expense that may accrue to persons or property occasioned by or arising out of the placing of said rubble and material on said City property; that such bond shall be in such form as may be approved by the Corporation Counsel, and shall have such surety as may be approved by the Commissioner of Finance, and shall be filed in the office of the Comptroller of the City of Saint Paul. 8.; Said permittee shall not proceed to place such rubble ;'and material unless and until said permittee shall have filed in the office of the Comptroller of the City of Saint Paul a liability insurance policy in such form as the Corporation Counsel of the City of Saint Paul may direct and said insurance shall be in compliance with Sections 1.42 through 1.44 contained ih_the City of f Saint Paul Department of Public Works Specifications for Street and Sewer construction dated April 1, 1959; that said Sections 1.42 through 1.44 of the Specifica- tions for Street and Sewer Construction are hereby incorporated herein by reference as fully and completely as if set forth herein verbatim. I 9.; Said permittee shall at all times indemnify and hold harmless the City of Saint Paul, its agents, officers and employees from any and all damages, claims, losses, judgments, suits or expenses arising out of or occasioned by the performance of the work contemplated by this permission and authority. 10i Said permittee shall pay the cost of publication of this ordinance and shall, within ten days after the passage of this ordinance, file a written acceptance 1 thereof with the City Clerk, in a form to be approved + by the Corporation Counsel. If such acceptance is not filed within said time, the authority hereby given shall be void. Sec. 3. This ordinance rendered peace, I health ,and Sec. 4. Shepardls letter of September 23, 1964, granting us permission to place concrete rubble and excavated material and also tIo stockpile gravel on City property in connection with our Snelling Avenue project. We have also received, along with your letter of Octoberj22, 1964, a copy of a resolution, Council File No. 220443 and a copy of the ordinance, Council File No. 220427 pertaining to the same matter. We hereby agree to the conditions as set forth in the letter, resolution and ordinance. The Chandler -Lang Agency of Minneapolis is arranging for the surety bond and the required insurance.
